CITY COUNCIL MEETING MAY 3, 1976

 

The Jonesboro City Council met in regular session, Monday, May 3, 1976, at 7:30 p.m. Present: City Attorney and councilmen: Bowers, Sanderson, Bridger, Burns, Minx, Smith, Hinson, Haggenmacher, Johnson, Hannah Darling and Stricklin, Absent: Mayor and City Clerk. In the absence of the Mayor, Vice-Mayor Stricklin presided.

 

Mr. Wally DeRoeck spoke on the property transfer between the City and Citizens Bank and also on the closing of the alley next to the Strand Theater running east & west through the east one-half of Block “G”. Mrs. Betty Sloan spoke on closing of the alley and stated that the Hotel & Motel Commission may need additional time for meetings to develop plans for the use of Strand Theater. Mr. Burns ask that the Advertising & Promotion Committee advise council of their recommendations of closing the alley south of the theater, running east & west.

 

Mr. DeRoeck informed council on the appraisals of the properties, which was made by Mr. Boyd McCrackin:

 

Strand Theatre                     $95,000.00

City Property                     55,000.00

 

Mr. Stricklin advised council that Mr. R.A. Thrasher has appraised the Strand Theatre property at $101,000.00

 

Mr. Hannah moved that the appraisals presented be accepted by council, seconded by Mr. Burns, Voting aye: Bowers, Sanderson, Bridger, Burns, Minx, Smith, Hinson, Johnson, Hannah and Stricklin. Voting nay, Haggenmacher and Darling.

 

The following bids were opened on two tracks:

 

Central Chevrolet                     $ 6,700.00

O’Neal Ford                                            6,578.37

 

Mr. Bridger moved to accept the low bid of O’Neal Ford, seconded by Mr. Haggenmacher. Voting aye: Bowers, Sanderson, Bridger, Burns, Minx, Smith, Hinson, Haggenmacher, Johnson, Darling and Stricklin. Voting nay, Hannah.

 

The following ordinance was on third and final reading and was withdrawn by request of the property owners:

 

AN ORDINANCE TO AMEND ORDINANCE #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGES IN ZONING BOUNDARIES

 

The following ordinances were on third and final reading and tabled for further action until May 17.

 

AN ORDINANCE AUTHORIZING THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS UNDER ACT NO. 9 OF THE FIRST EXTRAORDINARY SECTION OF THE SIXTY-SECOND GENERAL ASSEMBLY OF THE STATE OF ARKANSAS, APPROVED JANUARY 21, 1960, AS AMENDED, FOR THE PURPOSE OF PROVIDING PERMANENT FINANCING OF THE COSTS OF SECURING AND DEVELOPING INDUSTRIES (THE PARTICULAR INDUSTRIAL PROJECT IS DESCRIBED IN THE ORDINANCE); AUTHORIZING THE EXECUTION AND DELIVERY OF A TRUST INDENTURE SECURING THE BONDS: AUTHORIZING THE EXECUTION AND DELIVERY OF A TRUST INDENTURE SECURING THE BONDS: AUTHORIZING AND PRESCRIBING OTHER MATTERS PERTAINING TO THE INDUSTRIAL PROJECT, THE CONSTRUCTING THEREOF AND THE FINANCING THEREOF: AND DECLARING AN EMERGENCY 

 

AN ORDINANCE AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN THE CITY OF JONESBORO, ARKANSAS, AS LESSOR, AND SOUTHERN CAST PRODUCTS, INC. AS LESSEE IN SUBSTANTIALLY FOR AND WITH SUBSTANTIALLY THE CONTENTS SET FORTH IN AND MADE A PART OF THIS ORDINANCE: AUTHORIZING THE EXECUTION AND DELIVERY OF THE LEASE AGREEMENT: PRESCRIBING OTHER MATTERS RELATING THERETO: AND DECLARING AN EMERGENCY

 

The following ordinance was on third reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, CRAIGHEAD COUNTY, BY ORDER OF THE COUNTY COURT DATED MARCH 18, 1976 ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3) AND RESIDENTIAL (R-1), RESPECTIVELY DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Hannah moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Smith, with all members of council voting aye. The ordinance was given number 1501.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGE IN ZONING BOUNDARIES

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

Mr. Darling moved that the rules be suspended and the ordinance be placed on third and final reading, seconded by Mr. Bowers, all council voting aye. The ordinance was read for the third time and Mr. Darling moved for the adoption of same, seconded by Mr. Bowers with all members voting aye. The ordinance was given #1502.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE TO ESTABLISH A PENALTY PROVISION FOR FAILURE TO PAY FOR A VIOLATION OF THE OVERTIME PARKING ORDINANCE, SECTION 15-116 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, AND FOR OTHER PURPOSES

 

Mr. Haggenmacher moved that the ordinance be postponed indefinitely, seconded by Mr. Hannah with all members of council voting aye.

 

The following ordinance was on 1st reading and offered by Mr. Hannah:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 1204, SAME BEING AN ORDINANCE PROVIDING FOR THE BUILDING CODE FOR THE CITY OF JONESBORO, ARKANSAS

 

Mr. Darling moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Burns, all aye.

 

Mr. Darling then moved that the rules be further suspended and the ordinance be placed on third and final reading, seconded by Mr. Bowers, all council members voting aye. After the ordinance was read for the third time, Mr. Hannah moved for the adoption same to include the emergency clause, seconded by Mr. Bowers with all voting aye. The ordinance was given #1503.

 

The following ordinance was on 1st reading and offered by Mr. Burns:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 1244, SAME BEING AN ORDINANCE PROVIDING FOR THE FIRE PREVENTION CODE OF THE CITY OF JONESBORO, ARKANSAS

 

Mr. Hannah moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Haggenmacher, all aye. Mr. Hinson then moved that the rules be suspended and the ordinance be placed on third and final reading, seconded by Mr. Johnson with all members voting aye. After the ordinance was read the third time, Mr. Bowers moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Hinson. All councilmen voted aye and the ordinance was given #1504.

 

Mr. Stricklin advised council that the Police Department has three used vehicles, and Mr. Darling moved that permission be given for the City to ask for bids on them, seconded by Mr. Smith, all voted aye.

 

The following ordinance was offered by Mr. Hannah:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3: ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.

 

Mr. Minx presented to council a report from the Supervisor of trash pick-up. (Report attached to page 235 in minute book)

 

Mr. Bridger moved that council adjourn into executive session, seconded by Mr. Burns with all members voting aye.

 

Mr. Bowers offered the following Resolution:

 

RESOLUTION SETTING REQUIREMENTS FOR SUBMITTING AGENDA ITEMS

 

Mr. Hannah moved for the adoption of the resolution, seconded by Mr. Bridger, all aye. The resolution was given the number 1976:11.

 

There being no further business, council adjourned.
