AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED JUNE 10, 1969; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas Western District, on May 6, 1969; and
WHEREAS, said petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing and hearing upon said petition was duly had and held in the County Court on June 10, 1969, at which hearing it was duly found and declared by the court that said petition for annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, whereupon an Order of annexation was made and entered; and
WHEREAS, thirty days have expired since the Order of annexation dated June 10, 1969, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas:
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County, Arkansas, Western District, dated June 10, 1969, be, and they are hereby, accepted by the City of Jonesboro, Arkansas, and said territory, hereinafter described, shall hereafter be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants residing herein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
The South one-half of the Southwest Quarter, of the Southwest Quarter (19.77 ac.), Section 24; a fractional part of the South one-half, of the Southeast Quarter of the Southwest Quarter (6.27 ac.), Section 24; a fractional part of the Northwest Quarter of the Northwest Quarter (24.10 ac.), Section 25; a fractional part of the North one-half of the Northeast Quarter of the Northwest Quarter (3.40 ac.) Section 25, all being in Township 14 North of the Base Line, Range 3 East pf the Fifth Principal Meridian, Craighead County, Arkansas, and being more particularly described as follows: Beginning at the Southwest Corner of Brookhaven 3rd Addition to the City of Jonesboro, Arkansas, as recorded in Book 123, page 121in the office of the Circuit Court Clerk and Ex-Officio Recorder, Craighead County, Jonesboro, Arkansas, which point of beginning is on the West line of aforesaid Section 24, Township 14 North, Range 3 East and North 1° 06’ East 658.8 feet from the Southwest corner of aforesaid Section 24, Township 14 North, Range 3 East: thence South 1°06’ West along the West line of aforesaid Section 24 a distance of 658.8 feet; thence South 1°06’ West along a line between the Northwest corner of Section 25, Township 14 North, Range 3 East, afore described as the Southwest corner of Section 24, and an angle iron identified by property owners as being the Southwest corner of the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 25, aforesaid, a distance of 936.0 feet to the centerline of Wood Springs Road; thence in a Northeasterly and Easterly direction along the centerline of aforesaid Wood Springs Road as follows: North 87°28’ East 579.4 feet; thence Northeasterly along the arc of a 15.941 degree curve to the left 79.67 feet; thence North 74°46’ East 84.6 feet; thence Northeasterly along the arc of a 14.856 degree curve to the left 226.45 feet; thence North 41° 07’ 30” East 300.00 feet; thence Northeasterly along the arc of a 19.10 degree curve to the right 99.39 feet; thence North 60°30” East 82.84 feet; thence Northeasterly along the arc of a 17.3924 degree curve to the right 147.48 feet; thence North 85°45’30” East 94.30 feet; thence Easterly along the arc of a 16.106 degree curve to the right 99.30 feet; thence South 78°12’30” East 78.5 feet to a point on the West bank of Christian Creek on the centerline of aforesaid Wood Springs Road; thence leaving aforesaid Wood Springs Road and running North 4°16’ East along the general direction of Christian Creek 1066.5 feet to the Southeast Corner of Brookhaven 3rd Addition, aforesaid; thence South 89°40’ West along the South line of aforesaid Brookhaven 3rd Addition 1739.7 feet to the point of beginning proper and containing 53.54 acres, more or less and being subject to an easement along the West side of the tract for a City Water and Light Plant power line and being subject to an easement of 41 feet along the South side of the tract for Wood Springs Road.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are hereby assigned and attached to Ward 5.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
