AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED AUGUST 12, 1974; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, Western District, on July 12, 1974; and,
WHEREAS, said petition for the annexation of said lands was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and,
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on August 12, 1974, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order or annexation was made and entered; and
WHEREAS, Thirty (30) days has expired since the order of annexation dated August 12, 1974, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Western District of Craighead County, Arkansas, and annexation proceedings were in all things confirmed by the County Court by its order of August 12, 1974.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Western District, by its order of August 12, 1974, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein, shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to the City and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
The East 1.0 foot of the East 20 acres of the South Half of the Southeast Quarter of Section 28, Township 14 North, Range 4 East, less the South 296.3 feet thereof and, Richardson’s Trailer Park being more particularly described as follows: A part of the Southwest Quarter of the Southwest Quarter of Section 27, Township 14 North, Range 4 East; commencing at the Southwest corner of said Southwest Quarter of the Southwest Quarter; thence North 01°11’ East along the West line thereof a distance of 296.3 feet to the North right-of-way line of Highway #63 Bypass for the point of beginning proper; thence continue North along said West line 160.7 feet; thence East 210 feet; thence North 210 feet; thence East 767 feet to the West boundary line of the Missouri Pacific Railroad right-of-way; thence South 32°35’ West 352.9 feet along said railroad right-of-way to its intersection with the North right-of-way line of said Highway #63 Bypass; thence South 84°42’ West along said highway right-of-way line 793.7 feet to the point of beginning proper, and containing 5.67 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6, of the City of Jonesboro. Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to the accepted by the City of Jonesboro so that said property may be included in the city’s next census count; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
