METROPOLITAN AREA PLANNING COMMISSION

APRIL 13, 1999

 

MEMBERS PRESENT: Little, Damron, Gott, Finley, Beadles, Pitts, Shaw, Phillips

#1 RZ99-12 Sam Hester requested approval of rezoning from Residential R-2 to Commercial C-3 for Lot 1 of Sam Hester Replat of Lots 1-8, Block 1 and part of Lots 8-12, Block 2 of Mangrum ‘s Subdivision and part of Judy Street.    The general location of the property is on the south side of Nettleton Avenue, adjacent to Avondale Arms apartments at 209 E. Nettleton Avenue.

#2 RP99-12 Sam Hester requested approval of a replat of Lots 1-8, Block 1 and part of Lots 8-12, Block 2 of Mangrum‘s Subdivision and part of Judy Street.    The general location of the property is on the south side of Nettleton Avenue, adjacent to Avondale Arms apartments at 209 E. Nettleton Avenue.

#3 RZ99-15 Gene and Kay Barnett requested approval of rezoning from Residential R-1 to Industrial I-1 for Lot 1, Block A of Morrow Acres containing .89 acre.  The general location of the property is on the east side of Paragould Drive, north of Shagbark Lane.

 

Mr. Barnett stated that his plan was to build a warehouse on the site with removable partitions inside depending upon who tenants might be.  He went on to say the property is too small to subdivide and too large to use for a single family home and its adjacent to commercial zoning.

 

Residents from the area spoke in opposition to the rezoning and gave the MAPC some history of how they have tried to protect their area for a number of years and keep it R-1.  It was stated that several single family subdivisions had been built or were in the process of being built at this time.

 

A motion to disapprove the request due to spot zoning and inconsistency with the Land Use Plan was made by Dr. Beadles and seconded by Ms. Shaw.  Voting was 7 in favor, 0 opposed, MOTION CARRIED, REQUEST DISAPPROVED.

 

#4 RZ99-16 Afak Haydar requested approval of rezoning from Residential R-1 to Residential R-2 for Lots 4 & 5 of Charles A. Stucks 2nd Addition.  The property is located at 1211 Nettleton Circle.

#5 RP99-13 Afak Haydar requested approval of replat of Lots 4 & 5 of Charles A. Stucks 2nd Addition.  The property is located at 1211 Nettleton Circle.

#6 MP99-12 J. C. and Glenda Cleghorn requested approval of a minor plat containing 4.76 acres.  The property is located at 4800 Industrial Drive.

 

George Hamman stated that he would supply the two lot plat as required for the development of two homes. 

 

A motion to approve the request was made by Ms. Shaw subject to: 1) the r/w on Industrial Drive being addressed with MATA, 2) dividing the property into two lots, one for each residence, 3) providing floor elevation certificates in the flood plain, 4) removed noted #2 from the plat concerning an expiration of certification.  The motion was seconded by Dr. Beadles.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS. 

 

#7 SU99-6 J. C. and Glenda Cleghorn requested approval of placement of a mobile home at 4800 Industrial Drive.

 

A motion to approve the request was made by Mr. Damron and seconded by Ms. Finley.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED.

 

#8 RZ99-17 J. T. Barr, Barr Investments, Inc. requested approval rezoning from Residential R-1 to Commercial C-3 for 6.54 acres and from Residential R-1 to Residential R-3 for 24.42 acres located in the South Half of the SW 1/4 of Section 23, Township 14 North, Range 3 East.  The general location of the property is on the west side of Hwy. 63, south of Strawfloor Road and approximately ½ north of the Woodsprings Road interchange.

 

It was explained that this property has been part of a mining operation for many years and this owner is attempting to purchase the property, recover from the mining and develop it.  The property adjoins the frontage road for Highway 63 Bypass on the east, adjoins the city landfill on the west and Woodsprings Forest Subdivision on the south. 

 

A commercial development is already underway along the Bypass frontage and it is proposed for the frontage of this property to be commercial as well.  Mr. Barr’s proposal is to build 160 multifamily units on the 24 acres behind the commercial development.  He went on to say the units were first class, up scale and would bring rents from $550 to $850 and were not subsidized in any way through HUD.  The area will be totally fenced with wrought iron fence and bricked columns. 

 

Planning Commissioners asked many questions regarding the future of the property and what effects the landfill might have on the development.  They further stated that they did not want to see anything that resembled what is now known as apartment city.  Mr. Mooney stated that an environmental assessment would be performed prior to purchase of the property.

 

There was no opposition voiced by anyone in attendance.

 

Dr. Beadles made a motion to recommend approval to the City Council subject to site development plans being submitted to and approved by the MAPC.  The motion was seconded by Mr. Phillips.  Voting was 5 in favor, 2 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#9 RZ99-18 Don Throesch requested approval of rezoning from Agricultural AG-1 to Industrial I-1 for 23.48 acres located in the SW 1/4, NW 1/4 of Section 25, Township 14 North, Range 4 East.   The general location of the property is on the east side of Commerce Drive, north of Opportunity Drive.

 

It was noted that industrial zoning adjoins three sides of the property now and is part of the planned industrial development in the Land Use Plan.

 

A motion to recommend approval to the City Council was made by Mr. Pitts and seconded by Ms. Finley.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED.

 

#10 FP99-7 Carroll Caldwell requested final approval of plans for Deerfield Subdivision containing 25 lots on 8.71 acres.  The general location of the property is on the east side of Wimpy Lane, south of Southwest Drive.

 

Dr. Beadles made a motion to approve the request acknowledging that the developer agrees to comply with the staff comments in the staff analysis.  The 30' street right of way from centerline and the 30' drainage and utility easement are acceptable as proposed for Wimpy Lane.  The motion was seconded by Mr. Phillips.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#11 FP99-8 Carroll Caldwell requested final approval of plans for Friendly Hope Estates Phase II.  The subdivision contains 25 lots on 10.13 acres.  The general location of the property is on the east side of Friendly Hope Road, a continuation eastward of Bowden Drive.

 

Dr. Beadles made a motion to approve the request subject to compliance with the engineer comments as contained in the staff analysis.  The motion was seconded by Ms. Finley.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#12 PP99-6 Village Communities requested preliminary approval of Ridgeview Acres.  The subdivision contains 7 lots on 7 acres.  The general location of the property is east of Stadium Boulevard, behind the 5800 block of Stadium.

 

Dr. Beadles made a motion to approve the request subject to the following stipulations:

 

1.  Naming the unnamed street with an acceptable name

2.  Providing documented, recorded evidence that 60' of right of way exists or is being dedicated from Stadium to the end of the street and proper right of way for the cul-de-sac

3.  Correction of the sections of the street that exceed maximum grade of 10% grade

4.  Showing a minimum radius of 200' as required by ordinance

5.  Off site drainage to be shown demonstrating how they would get  rid of water

6.  Revise plans to show revisions

7.  Providing information regarding the status of the mobile home that is located in the r/w at this time.

 

The motion was seconded by Mr. Pitts.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#13 FP99-9 M. L. Coleman requested final approval of plans for Throgmartin Estates Phase III.  The subdivision contains 15 lots on 4.9 acres.  The general location of the property is on the east side of Elizabeth Lane, a continuation of Nathan Drive eastward.

 

Dr. Beadles made a motion to approve the request subject to:

 

1.  Verification that the preliminary plan calls for a through street and not a cul-de-sac

2.  Making the drainage corrections as agreed to by the developer

3.  Issue no building permits in this phase until the drainage problems are corrected

 

The motion was seconded by Ms. Finley.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#14 PP99-8 Robert Sartin requested preliminary approval of subdivision plans for Woodsprings Forest Phase II.  The subdivision contains 4 lots on 1.72 acres.  The general location of the subdivision is on the north side of Casey Springs Road, west of Lion Heart Lane, and a continuation westward of Nottingham Way.

 

It was noted that the plans presented by John Morris for Phase II were never finalized and he never took possession of the property. 

 

Mr. Pitts made a motion to grant preliminary approval of the request subject to:

 

1.  Review of all engineering plans

2.  Full compliance with subdivision requirements next month

3.  Compliance with cul-de-sac requirements

 

The motion was seconded by Dr. Beadles.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#15 PP99-7 Bob and Joann Haun requested preliminary approval of plans for Tower Park Estates Phase Five.  The subdivision contains 10 lots on 5.2 acres.  The general location of the property is on north side of Neely Road, west side of Tower Park Drive, and a continuation of Skyline Cove and Pinnacle Pointe.

 

It was noted that preliminary approval was granted a few years ago on the overall subdivision and Mr. Haun is actually requesting final approval on phase five.

 

Dr. Beadles made a motion to grant final approval of the subdivision request subject to:

 

1.  Compliance with the engineer comments contained in the staff analysis

2.  Showing the right of way on Neely Road

3.  Revise the plans to correct the erroneous lot dimensions

 

The motion was seconded by Mr. Pitts.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#16 SP99-7 Kenneth Sulcer requested approval of site plans to add eight apartment units in two buildings to the site at 2204 and 2210 Conrad Drive.

 

Dr. Beadles made a motion to approve the request subject to:

 

1.  Providing the replat of the property for the portions of lots

2.  Showing parking for the whole development

3.  Providing a drainage plan including topo information

4.  Correction of and compliance with minimum setbacks

 

The motion was seconded by Ms. Finley.  Voting was 6 in favor, 0 opposed, 1 abstaining, REQUEST APPROVED WITH STIPULATIONS.

 

In other business Jeff Hawkins, City Planner, presented a letter to the MAPC regarding the rezoning of property at 4114 Forest Hill Road for Jim Lackey.  Mr. Lackey was under contract to purchase the property but never purchased the property.  It was stated that the rezoning should be invalid due to ownership requirements. 

 

A motion was made by Ms. Shaw and seconded by Dr. Beadles to recommend repealing of the rezoning ordinance for 4114 Forest Hill Road to the City Council.  All members present voting aye, MOTION CARRIED.
