CITY COUNCIL MINUTES, MARCH 21, 1983

 

The Jonesboro City Council met in regular session, Monday, March 21, 1983, at 7:30 p.m. Present, Mayor, City Attorney, City Clerk and all aldermen except: Dr. Smith.

 

The minutes of March 7, 1983, were approved as mailed on motion by Mr. Sanderson, seconded by Mr. Mays, all aye.

 

The following bids were up for review:

 

A) Building Insurance - A motion from Mr. Hannah to accept the bid from General Insurance

Agency for $4,940.00, seconded by Mr. Shelton. All voted aye.

 

B) Public Employees Bond - A motion from Mr. Hannah to accept the bid from Martin & Associates for $1,521.20, seconded by Mr. Shelton. All voted aye.

 

On review of the rules and regulation of the Fire and Police Departments, the Mayor asked that they be offered at the next Council meeting to give more time to study the rules. He also asked that the aldermen consider the addition that would require new applicants to be living in or moving into the city limits upon being hired.

 

It is hereby stated in the minutes that the second reading of the ordinance dealing with the “City of Jonesboro, Arkansas Public Facilities & Tourism Board” that was read on March 7, 1983, has been omitted due to the lack of a two-thirds vote to suspend the rules. Therefore, the following ordinance was up for the second reading:

 

AN ORDINANCE AMENDING ORDINANCE #1657 TO ALLOW THE CITY OF JONESBORO, ARKANSAS RESIDENTIAL HOUSING FACILITIES BOARD TO DEVELOP AND PROVIDE FINANCING FOR RECREATIONAL AND TOURIST FACILITIES AND TO CLARIFY ORDINANCE #1657 AS IT RELATES TO MULTI-FAMILY HOUSING

 

City Attorney, Judy Hinson, approached the Council and explained that the City of Jonesboro filed a Cross-Complaint against East Arkansas Cablevision, Inc. She also stated that she will file a petition with the FCC requesting that they waive rule 76.31 which limits the franchise fees which a municipality may collect from cable companies to 3% of their gross revenue. Once the petition is officially denied, the City may appeal to the United States Court of Appeals. She explained that the procedure may take several years. She also stated that she is going to ask for a declaratory judgment on the meaning of “gross receipts” to see if HBO and Cinemax fall under such receipts.

 

The Mayor stated that the ordinance dealing with the rezoning request from R-2 to C-5 at 1606 South Main has been tabled at this time by request of Dr. Jim Wagner.

 

City Inspector, Joe Tomlinson, submitted five persons for consideration to be members of the Building Code Board of Adjustments and Appeals.

Mr. Sanderson reported that the Sanitation Committee will meet before the next Council Meeting to decide if there will be a spring clean-up, it would start April 11th.

 

A Jonesboro resident, Robert Rees approached the council to state that he had property on the corner of Matthews and Gee Street and that the MAPC required that he release 52% of the land for easements. He was instructed that before the council took any action on the matter he would need to make a formal appeal to the council within 30 days of any MAPC action.

 

Mr. Hannah moved that the meeting be adjourned, seconded by Mr. Mays, all aye.

 

There being no further business, council adjourned.
