AN ORDINANCE TO AMEND ORDINANCE NO. 776 SAME BEING AN ORDINANCE PROVIDING FOR A BOARD OF EXAMINERS OF ELECTRICAL, CONTRACTING, INDUSTRIAL PLANT ELECTRICIANS, AND ELECTRICAL MAINTENANCE MEN; AND PROVIDING RULES AND REGULATIONS FOR THE EXAMINATION OF ALL PERSONS ENGAGED IN ELECTRICAL WORK, TOGETHER WITH PENALTIES FOR VIOLATIONS, AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: That from and after the passage of this ordinance, section 1 of ordinance no.776 passed November 15, 1948, shall be amended to read as follows:
 
There is hereby created a Board of Examiners of Electricians and Supervisors of all persons, firms and corporations engaged in electrical work, which will hereafter be referred to as "Board." Said Board shall be composed of five members, one of whom shall be a reputable person engaged in the business of an architect, two electrical contractors who are master electricians, the manager of City Water & Light Plant or some one of his staff designated by said manager, the Mayor or some member of the City Council appointed by the Mayor with the approval of the council. Appointments to the Board shall be made by the Mayor with the approval of the City Council upon the first council meeting in January of each ear hereafter. Members of the Board shall serve for a term of two years. Two of the members immediately appointed shall serve for a term of one year, and two of such members shall serve for a term of two years; the manager of the City Water and Light Plant, or such person designated by him being a permanent member. Such four members shall immediately draw lots to determine who shall serve terms of one and two years. In case of a vacancy upon such board the Mayor shall appoint, within the approval of the Council, some person to serve out the unexpired term of the member causing the vacancy.
 
SECTION 2:   BOARD OF REVIEW:
Ordinance No.776 shall be amended by the addition of the following section:
 
There is hereby created a Board of Review which shall consist of the entire membership of the Board of Examiners of Electricians and Supervisors. Each member of the Board of Review shall serve without pay.
 
Any person, firm or corporation may register an appeal with the Board of Review for a review of any decision of the Electrical Inspector, provided that such appeal is made in writing within five days after such person, firm or corporation shall have been notified of such decision by the Electrical Inspector. Upon receipt of such appeal the said Board shall proceed to determine whether the action of the Electrical Inspector complies with this ordinance within five days shall make a decision in accordance with its findings. The Board shall have power to affirm, reverse or modify any decision of the Electrical Inspector. Three members of the Board present at any meeting shall constitute a quorum for the transaction of business but any action taken at any meeting shall require the affirmative vote of at least three members. The chairman of any meeting of the Board shall vote.
 
REVOCATION CLAUSE: Any license granted under this Ordinance may be revoked by the Board of Review or by the Board of Examiners of Electricians and Supervisors, if the holder of same violates any ordinance or law related to electrical wiring, or is guilty of electrical construction which is hazardous to life or property, or transfers or allows, directly or indirectly, any person, firm or corporation, other than lawful holder, to operate under, or obtain permits to do work under said certificate; provided the holder of same shall be found guilty by the Board of such violations. When a license is revoked a new license will not be issued to the same firm, person or corporation for a person of not less than 30 days, and then only after successfully taking the required examination for such Certificate of Competency.
