AN ORDINANCE TO AMEND ORDINANCE NUMBER 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That Ordinance Number 954 known as the Zoning Ordinance of the City of Jonesboro be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows:

 

From Residential (R-1) to Commercial (C-5) of property described as follows: (Methodist Hospital of Jonesboro, Inc. /by Dan Mulhollen)

 

LEGAL DESCRIPTOIN

 

All of Lot c of the Spurlock 2nd Addition, Jonesboro, Arkansas as shown by plat as recorded in Deed Record Book 179 Page 26 in the office of the Circuit Clerk of Craighead, Arkansas, AND the south half of Apache Avenue east of Middlefield Drive as shown by plat as recorded in Deed Record Book 198, Page 11 in the office of the Circuit Clerk of Craighead County, Arkansas, said street closed by Ordinance Number 1887 of the City Council of the City of Jonesboro August 6, 1984, LESS AND EXCEPT a tract forty feed by forty feet (40’x40”) near the northeast corner of said Lot C, all in the Southeast Quarter of the Southeast Quarter (SE ¼) of Section 28, Township 14 North, Range 4 East of the 5th Principal Meridian in Craighead County, Arkansas, Arkansas, all more particularly described as follows;

 

From the northwest corner of the Southeast Quarter of the Southeast Quarter (SE ¼, SE ¼) of said Section 28, thence N89˚57’ E 60.00 feet to a Point in the centerline of Apache Avenue closed by said Ordinance Number 1887, a point on the easterly right-of-way of Middlefield Drive, the Point of Beginning;

 

Thence N89˚57’ E 607.40 feet along the centerline of Apache Avenue closed by said ordinance to the east right-of-way thereof, thence S00˚03’E 30.00 feet to a point on the north line of Lot C of said Spurlock 2nd Addition, thence N89˚57” E 637.25 feet along the north line of said Lot C to the northeast corner thereof, thence S00˚49’ W 460.00 feet along the east line of said Lot C to the southeast corner thereof, thence S89˚57’W 1243.9 feet along the south line of said Lot c to the southwest corner thereof, said point being located on the easterly right-of-way of Middlefield Drive, thence N00˚41’ E 460.00 feet along side right-of-way of Middlefield Drive to the northwest corner of Apache Avenue closed by said Ordinance Number 1887, the Point of Beginning, containing some 13,555 acres, more or less in the aggregate, LESS AND EXCEPT the following described property;

 

A part of Lot C of the Spurlock 2nd Addition to Jonesboro, Arkansas, more particularly described as follows;

 

From the Northeast corner of the Southeast Quarter of the Southeast Quarter (SE ¼, SE ¼) of said Section 28, thence S89˚57’ W 30.00 feet to a point, thence S00˚49’ W 30.00 feet to the Northeast corner of Lot C of said Spurlock 2nd Addition, continue thence S00˚49’W 10.00 feet to a point, thence S89˚ 57’ W 30.00 feet to the Point of Beginning;

 

Thence S00˚ 49’W 40.00 feet to a point, thence S89˚57’W 40.00 feet to a point, thence N00˚49’E 40.00 feet to a point, thence S89˚57’ E 40.00 feet to the Point of  Beginning, containing some 0.037 acres in said exception and leaving a net acreage of 13.518 acres, more or less.

 

Section 2: It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is being delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effects from and after its passage and approval.

 

PASSED AND ADOPTED this 5th day of October, 1987.
