WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas on the 6th day of April, 1988, asking the City Council to vacate and abandon all that portion of the streets and alleys known as 3rd, 4th, 5th & 6th Streets between Johnson Aveune and Word Streets and the alleys running north and south and/or east and west in Blocks 5, 6, 7, 8 & 9 of Barritts (Barretts) Addition to the City of Jonesboro designated on the plat of the Barritts (Barretts) Addition to the City now appearing of record in Plat Book 20 Page 362-363 in the Office of the Recorder of Craighead County.
 
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets and alleys or the portion thereof, hereinbefore described, have heretofore been dedicated to the public use as streets and alleys herein described; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; or that such streets are not necessary for highway purposes and that the public welfare and safety would be enhanced by vacating and abandoning said streets and alleys; that all the owners of the property abutting upon the portion of the streets or alleys to be vacated have filed with the Council their written consent to the abandonment; and that public interest and welfare will not be adversely affected by the abandonment of the streets and alleys.
 
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: The City of Jonesboro, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the streets and alley designated as follows: 3rd, 4th, 5th & 6th Streets between Johnson Avenue and Word Street and the alleys running north and south and/or east and west in Blocks 5, 6, 7, 8 & 9 of Barritts (Barretts) Addition to the City of Jonesboro.
 
SECTION 2:  A copy of the ordinance duly certified by the City Clerk or town recorder shall be filed in the office of the Recorder of the County and recorded in the deed records of the county.
 
SECTION 3: It is now determined that the closing of portions of these streets and these alleys is necessary for the immediate preservation of the public safety and welfare and an emergency is hereby declared and this ordinance shall take effect from and after its passage.
 
PASSED AND ADOPTED this 2nd day of May, 1988.
