IV.                     NEW BUSINESS

Light handed out a preliminary ordinance to repeal the original ordinance and to adopt the manual.  Light stated that the ordinance had not been reviewed by the City Attorney but that it would be sent to him for his opinion.  A copy of the preliminary ordinance is attached.

V.                     PENDING ITEMS

Light stated that there were no public comments.  He stated that he had spoken with some pipe companies that are looking at the pipe section but has not received any comments.

Light explained that City staff had five (5) items that would make the requirements more stringent.  (1)  Buffering from the floodway.  There is no buffering currently.  (2)  Parking lots in the floodway.  Currently, they are not allowed but with the passage of the new ordinance they will be allowed.  FEMA will allow parking lots in the floodway.  Light stated that if it is allowed it could be with some restrictions, such as no overnight parking.  (3)  No manufactured homes in the floodplain.  Light stated that FEMA recommended this.  Street stated there was a State law recently passed regarding manufactured homes.  Light will check into this.  (4)  All critical care facilities built outside of the 500-year floodplain.  (5)  Substantial improvements to structures.  Light suggested making substantial improvements cumulative over a 5-year or 10-year period.  Light stated that currently improvements can be split to come in under the 50% of assessment vs. construction cost.  Light also mentioned lowering the threshold from the current 50%.  He stated that 50% is set by FEMA and he was o.k. with leaving it.  Light stated that these are suggestions by City staff and wanted the Board to consider them before the adoption of the Regulations and Manual.

Daniels came in 8:43 a.m.
