AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED DECEMBER 31, 1968; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, Western District, on November 25, 1968; and
WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on December 31, 1968, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, 30 days has expired since the order of annexation dated December 31, 1968, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings was in all things confirmed by the County Court by its order of January 31, 1969.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, by its order of December 31, 1968, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein, shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to the City and accepted by the City of Jonesboro, Arkansas are more particularly described as follows, to-wit: Caraway Road and Highway 18:
A part of the Northwest Quarter of Section 28, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Northwest Corner of aforesaid Section 28; thence South on the section line 190.0 feet to the point of beginning proper thence South on the section line 1190.0 feet; thence East parallel with Arkansas Highway #18 a distance of 560.0 feet; thence North parallel with the section line 1190.0 feet; thence West parallel with Arkansas Highway #18 a distance of 560.0 feet to the point of beginning proper, containing 15.298 acres and being subject to a Public Road Right-of-Way off and across the West side thereof.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5, of the City of Jonesboro, Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the City’s next census count; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
