CITY COUNCIL MINUTES - FEBRUARY 20, 2001
 
The Jonesboro City Council met Monday, February 20, 2001, at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk Donna Jackson, City Attorney Phillip Crego, and 10 council members. Those members were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Vice Mayor Perrin presided over the meeting in the absence of Mayor Brodell who was out due to illness.
 
Councilman Roddy moved, seconded by Councilman Young to approve the minutes of February 5, 2001, as provided. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Councilman Tate moved, seconded by Roddy to approve the minutes of the Special Called meeting of February 8, 2001, as provided. A voice vote was taken resulting in all members voting aye. Those members were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
Councilman Copeland offered the following ordinance to be read by title only:

Councilman Young moved, seconded by Councilman Rega to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Councilman Young moved, seconded by Councilman Tate to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Councilman Young moved, seconded by Councilman Copeland for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. The ordinance was assigned number 3271.
 
Councilman Rega offered the following ordinance for first reading:

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Rega to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Roddy for the adoption of the ordinance. Councilman Roddy offered the following ordinance for first reading:

For the record, Councilman Rega recused himself from voting, due to a conflict of interest, and to avoid any appearance of impropriety. Councilman Roddy moved, seconded by Councilman McCall to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye, with the exception of Councilman Rega who abstained from voting. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Province, Copeland, Perrin and Roddy. Councilman Young moved, seconded by Councilman Roddy to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye, with the exception of Councilman Rega who abstained from voting. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Province, Copeland, Perrin and Roddy. Councilman Copeland moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye, with the exception of Councilman Rega who abstained from voting. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Province, Copeland, Perrin and Roddy. The ordinance was assigned ordinance number 3273.
 
Councilman Tate moved, seconded by Councilman Province to grant a conditional use permit to Mr. Terry L. Henson for the placement of a mobile home to be located at 3009 Bunting Drive. The request was made on behalf of Mr. Henson's mother, Mrs. Alma Gandy, for health reasons. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
Councilman Tate moved, seconded by Councilman Roddy to set an appeal hearing for March 5, 2001, at 6:10 p.m. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. The motion was later withdrawn at the request of Attorney Robin Nix, Jr. on behalf of his clients, Elaine Hallum and Joe Heinemann.
 
Councilman Kelton moved, seconded by Councilman Tate for the adoption of a resolution requesting City Water and Light to provide a free water meter for the sprinkler system located in the South-Side Softball Complex. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy. The resolution was assigned number 2001:07.
 
Under new business, Councilman Kelton reported he would be calling (in the near future) a meeting of the Planning and Inspection Committee to review recommendations by the Arkansas Municipal League, regarding the legalities of handling zoning matters.
 
Councilman Tate reported the Street Committee had met and reviewed bids for a Regenerative Street Sweeper and recommended River City #2, at a cost of $94,625.00 after trade-in. Councilman Young moved, seconded by Councilman Roddy to accept the low bid meeting bid specifications. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
Councilman Tate also requested that Ordinance No. 2718, which pertains to the abandonment of Word Street between Fourth Street and McClure Street, be amended to repeal Section Three. Section Three states, "That all utility Easements remain as currently existing on deed records. That the Streets in question will not be physically closed to the public until the intersection of Johnson & Culberhouse is improved." Councilman Tate explained at the time Ordinance No. 2718 was adopted, it was recommended that the ordinance not go into effect until the intersection at Johnson and Culberhouse was approved for a traffic signal, and even though bids were taken for the traffic signal, right of ways were not obtained so the contract was cancelled. Councilman Tate further explained the signalization will be included in current improvements to Johnson Avenue but will not be completed for another 14 to 18 months. Meanwhile, Arkansas Glass Container wishes to proceed with their expansion and requests the street be closed. City Clerk, Donna Jackson was asked to prepare an ordinance for the next council meeting to repeal section three of Ordinance No. 2718.
 
Councilman Tate lastly explained the Street Committee, after much discussion, made the recommendation to do away with the 10% retainer fee on all future Mata projects. He explained there is already a 100% performance payment bond requirement, and the Arkansas State Highway Department did away with the 10% retainer fee about 19 years ago. Councilman Tate moved, seconded by Councilman Kelton to remove the 10% retainer fee from future projects. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
Councilman Province moved, seconded by Councilman Rega to sell property (12 foot by 12 foot lot) located at 2216 Wilkins for $2,700.00 with the understanding that if the City of Jonesboro ever needs the property for future developments it will be sold back to the City of Jonesboro for $2,700.00. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
Councilman Tate moved, seconded by Councilman Roddy to purchase property located at Union and Burke for $22,500.00 to come from the Building Fund under Capitol Improvements for Land and Equipment. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Perrin and Roddy.
 
With no further business, the meeting was adjourned.
