AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED PORTION OF MURRAY CREEK DRIVE

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the streets designated as follows:
LEGAL DESCRIPTION
The South Seventy Five feet (75') more or less of Murray Creek Drive as shown by plat recorded in Plat Cabinet B at page 93 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas, more particularly described as follows:
From the Southwest Corner of Lot 49 of the Murray Creek Subdivision, Phase Iii, Jonesboro, Arkansas as shown by plat recorded in Plat Cabinet B at page 93 in the office of the Circuit Clerk for the Western District of Craighead County in Jonesboro, Arkansas, the point of beginning;
Thence Northwesterly 105.24 feet along the Westerly Right Of Way of Murray Creek Drive along a curve to the Left , said curve having a central angle of 29°12'55" and a radius of 206.39 feet, said point hearing N14°21'35"W and positioned 104.10 feet distant from the previous point, thence Easterly 83.87 feet along a curve to the left to a point on the Easterly Right Of Way of said Murray Creek Drive, said curve having a central angle of 96°066'27" and a radius of 50.00 feet, said point bearing S77°01'16"E and positioned 74.38 feet distant from the previous point, thence Southeasterly 83.82 feet along a curve to the Right along the Easterly Right Of Way of Murray Creek Drive, said curve having a central angle of 18°01'45" and a radius of 2666.39 feet, said point bearing S09°11'48"E and positioned 83.48 feet distant from the previous point, to the Southwest Corner of Lot 48 or the Murray Creek Subdivision, Phase III aforesaid, thence S88°20'24"W 60/03 feet along the South Line of Murray Creek Subdivision, Phase III aforesaid to the Southeast Corner of said Lot 48, the point of beginning, containing some 0.162 acres, more or less.
SECTION 2: A copy of the Ordinance certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas and shall be filed in the deed records of such office.
SECTION 3: The City Council of the City of Jonesboro, Arkansas finds and declares that the above streets and portions of streets are not necessary for the general benefit and welfare of the public; that the owners of all the property abutting the above streets are in favor of the closure and vacation of the above street and that therefore an emergency is declared to exist and this Ordinance shall take effect and be in full force from and after its passage and approval.
