NOW, therefore, be it ordained by the City Council of the City of Jonesboro, Arkansas:
 
Section 1: The City Council of the City of Jonesboro, Arkansas as authorized under the laws of the State of Arkansas, desires to widen East Nettleton Avenue from Caraway Road to Young Street, also known as Stadium Boulevard.
 
Section 2: The City of Jonesboro desires to widen East Nettleton Avenue to provide better access and more convenient traffic flow for the Citizens of the City of Jonesboro, Arkansas. East Nettleton Avenue from Caraway Road to Young Street, also known as Stadium Boulevard, needs to be improved.
 
Section 3: East Nettleton Avenue between Caraway Road and Young Street, also known as stadium Boulevard, is a city street located within the confines of the municipality.
 
Section 4; Certain private property described hereafter must be condemned in order that East Nettleton Avenue between Caraway Road and Young Street, also known as Stadium Boulevard, can be widened. This property is owned by Baldwin Oil Company, Inc. and Baldwin Petroleum Company, Inc. This property is described as follows:
 
Tract 1-E: Part of Lot 13, Cobb & Lee Survey, an addition to the City of Jonesboro, Arkansas, being a part of the NW ¼ of Section 21, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Beginning at a point on the existing northerly right-of-way line of Nettleton Avenue that is 30.7 feet left of and perpendicular to Centerline Station 5+30.0 of said point being also the Southwest Corner of Lot 13, Cobb and Lee Survey; thence North 00°21' East along the West line thereof a distance of 4.3 feet to a point; thence South 89°39' East a distance of 138.6 feet to a point; thence South 00°21' West a distance of 4.7' feet to a point on said existing right-of-way line of Nettleton Avenue; thence North 89°29' West along said existing right-of-way line a distance of 138.6 feet to the point of beginning and containing 623 square feet, more or less.
 
Tract 1-E-1: Part of Lot 13, Cobb and Lee Survey, an Addition to the City of Jonesboro, Arkansas, being a part of the Northwest Quarter of Section 21, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Beginning at a point on the West line of Lot 13, Cobb and Lee Survey, that is 40.0 feet left of and perpendicular to Centerline Station 5+30.0 of Nettleton Avenue; thence South 89°39' East a distance of 138.6 feet to a point; thence South 00°21' West a distance of 5.0 feet to a point; thence North 89°39' West a distance of 138.6 feet to a point on said West line of Lot 13; thence North 00°21' East along said West line a distance of 5.0 feet to the point of beginning and containing 693 square feet, more or less.
 
The City states, that this property be condemned for the construction of East Nettleton Avenue.
 
Section 5: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that East Nettleton Avenue between Caraway Road and Young Street, also known as Stadium Boulevard, should be widened and improved and that certain property described above must be condemned in order that these improvements be constructed, and that, therefore, this ordinance is needed to preserve the public peace, health and safety, and therefore an emergency is hereby declared to exist and this Ordinance shall take effect from and after its passage and approval.
 
PASSED and ADOPTED this 5th day of December, 1977.
