ORDINANCE TO VACATE AND ABANDON GUY STREET

BE IT ORDAINED by the Mayor and Council of the City of Jonesboro, Arkansas:
WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Craighead County, Arkansas, on the 19th day of September, 1960, asking the City Council to vacate and abandon a street known as Guy Street in the City of Jonesboro, (formerly Town of Nettleton), Arkansas, as shown on plat of said blocks as same appears in Deed Record 48, Page 110-G, in the office of the of the Circuit Clerk at Jonesboro, Arkansas, designated as follows:
Guy Street between Lots 1 and 7, Block A, Roleson’s Addition, and Lot 16 and Lot 17 of Cobb and Lee’s Survey of the Southeast Quarter of the Southwest Quarter of Section 22, Township 14 North, Range 4 East (Nettleton Township), Jonesboro, Arkansas.
WHEREAS, after due notices as required by law the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinabove described as heretofore been dedicated to the public use as a street and has not been actually used by the public generally for a period of five (5) years prior to the filing of the Petition for abandonment; that all owners of the property abutting that portion of the street to be vacated have filed with the City Council their writt4en consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street.
NOW, THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the street designated as follows:
Guy Street between Lots 1 and 7, Block A, Roleson’s Addition, and Lot 16 and Lot 17 of Cobb and Lee’s Survey of the Southeast Quarter of the Southwest Quarter of Section 22, Township 14 North, Range 4 East (Nettleton Township), Jonesboro, Arkansas.
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the county and recorder in the deed records of the county.
Section 3: This Ordinance shall take effect and be in force from and after its passage.
