AN ORDINANCE TO AMEND SECTION 13-37 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO TITLED, PAWNBROKERS AND REQUIREMENTS TO BE MET BY PAWNBROKERS, IN THE CITY OF JONESBORO, ARKANSAS, AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that Section 13-37 of the Code of Ordinances of the City of Jonesboro is hereby amended to read as follows:
 
Section 1: In addition to the license fee which is now or may hereafter be collected every years from persons engaged in the Pawnbrokers Business, such persons shall be subject to the following additional regulations in the conduct of their business as a pawnbroker:
 
It shall be the duty of each pawnbroker, his or its agents, servants and employees, to keep in a plain and intelligent manner, a written record in a permanent record book of each transaction in each pawnbrokers business in which pawnbroker lends, advances, or pays money or anything of value, on which personal property is pledged, sold, bartered, or exchanged. The following information shall be obtained by the pawnbroker and placed in the permanent record book:
 
1.      Name and address of the person with whom transaction is made;
2.      The drivers license number and/or social security number of the person that transaction is had;
3.      Ownership of property involved;
4.      Description of property involved;
5.      Amount of money loaned, advanced, or paid thereon;
 
Such records to be so kept upon the business premises and shall be at all times subjects to the inspection of the Mayor, Chief of Police, a police officer on duty, and the City Attorney, upon demand by any of them. It is hereby further provided that in all cases whereby any such article or personal property is still in possession of the pawnbroker are subject to his control it shall at all times be subject to the inspection of said officers upon said demand by any of them to see the article itself.
 
Section 2: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
 
Section 3: It is hereby declared by the City Council that Sesction 13-37 of the Code of Ordinances should be amended to place additional requirements on pawnbrokers in order to keep more accurate records of each transaction involving individuals in the pledge, sale, barer, or exchange of personal property, therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health, and safety, it shall take effect and be in full force from and after its passage and approval.
