AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL ( R-1 ); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead, County, Arkansas, on December 11, 1989: and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to the annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas on January 19, 1990, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands herein after described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made an entered; and
WHEREAS, thirty days having expires since the order of annexation dated January 19, 1990, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of February 21, 1990.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of January 19, 1990, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: Grissom/ encompasses remainder of Southview Acres, a subdivision in Valley View community which was split by the mass annexation by the city/ S. Mooney, Sr.
Part of Section 12, Township 13 North, Range 3 East, Craighead County, Arkansas, being more particularly described as follows: Begin at the Southeast Corner of Section 12, Township 13 North, Range 3 East: thence North 0°17' East along the East line, of said Section 12, 1281.9 feet; thence West 2526.6 feet to the point of beginning proper; thence along an agreed property line fence as follows: South 88°00' West 218.5 feet, North 88° 56' West 195.9 feet, North 3°56' East 30.2 feet, North 88°37' West 162.5 feet, North 88° 28' West 287.0 feet, North 88°48' West 210.1 feet, North 87°34' West 269.0 feet, North 87°06' West 277.5 feet, North 20°08' East 1357.1 feet; thence South 19°50' West 651.9 feet South 27°11' West 221.6 feet, South12°30' West 288.4 feet, South 40°16' West 57.7 feet, South 13°47' West 175.4 feet, to the point of beginning proper, containing 49.486 acres and being subject to a 20.0' drainage easement along the East side of the tract as shown on the plat of survey hereon.
SECTION 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.
SECTION 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1).
SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. There-fore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
