AN ORDINANCE TO AMEND TITLE 14, OF THE JONESBORO MUNICIPAL CODE KNOWN AS THE ZONING ORDINANCE PROVIDING FOR A CHANGE IN ZONE DISTRICT BOUNDARIES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: That Title 14 of the Jonesboro Municipal Code known as the Zoning Ordinance of the City of Jonesboro, Arkansas be amended by a change in zoning district boundaries as follows: R-1 (single family residential) to C-3 (general commercial district)
A part of the Southeast Quarter of the Northwest Quarter of Section 28, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows:
TRACT 1
From the center of said Section 28; thence N89°54'57"W 101.40 feet along the South Line of the SE 1/4 of the NW 1/4 said Section 28, to a point; thence North 53.66 feet to the point of beginning; thence S87°11'41"W 197.13 feet along the Northerly Right Of Way of Race Street to a point; thence S81°21'54"W 17.94 feet along the Right Of Way of Race Street to a point; thence N89°54'57"W 172.05 feet along the Right Of Way of Race Street to a point; thence N00°58'48"E 311.65' feet to a point; thence S89°54'57"E 428.64 feet to a point on the Westerly Right Of Way of Arkansas Highway Number 1; thence S00°56'26"W 258.87' feet along the Westerly Right Of Way of Arkansas Highway Number 1 to a point; thence S47°03'37"W 58.79 feet along the Westerly Right Of Way of Arkansas Highway Number 1 to the point of beginning; containing some 3.000 acres, more or less, subject to a utilities easement on the South and East Sides as shown on the recorded plat thereof (Book "F", page 51).
TRACT 2
A part of the Southeast Quarter of the Northwest Quarter of Section 28m Township 14 North, Range 4 East, more particularly described as follows: begin at the center of Section 28 aforesaid; thence North 89°54'57" West 101.40 feet along the South Line of said Southeast Quarter of the Northwest Quarter; thence North 53.66 feet to a point on the Northerly Right Of Way of Race Street; thence North 47°03'37" East 58.79 feet along the Right Of Way of Arkansas Highway No. 1; thence North 00°56'26" East 258.87 feet along the Westerly Right Of Way of Arkansas Highway No. 1 to the point of beginning proper; thence North 89°54'57" West 428.64 feet; thence North 00°58'48" East 101.65 feet; thence South 8954'57" East 103.57 feet; thence S00°56'26" West 30 feet; thence South 89°54'57" East 325.00 feet to a point on the Westerly Right Of Way of Arkansas Highway No. 1; thence South 00°56'26" West 71.65 feet to the point of beginning proper, containing 0.78 acre, more or less, and being subject to a utilities easements along the eastside thereof.
SECTION 2: It is found and declared by the City Council that proper use of the tract of land described in the Ordinance is delayed because of improper zoning and that, therefore, and emergency exists and this Ordinance being necessary for the preservation of the public peace health and safety, it shall take effect form and after its passage and approval.
