AN ORDINANCE TO AMEND TITLE 14 OF THE JONESBORO CODE OF ORDINANCES, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS LOCATED ON KATHLEEN STREET BETWEEN MORTON DRIVE AND PACIFIC ROAD AS REQUESTED BY TROY COLEMAN/JAY HARMON (NOTE: THIS ORDINANCE WAS DENIED ON AUGUST 7, 2007)

WHEREAS, the following described lands are currently zoned "AG-1" Agricultural:
 
ALL OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER AND ALL THAT PART OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER LYING SOUTHEAST OF RIGHT-OF-WAY LINE OF MISSOURI PACIFIC RAILROAD AND A PART OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER LYING SOUTHEAST OF RIGHT OF WAY LINE OF MISSOURI PACIFIC RAILROAD IN SECTION 23, TOWNSHIP 14 NORTH, RANGE 4 EAST, CRAIGHEAD COUNTY, ARKANSAS AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
 
Beginning at the Southeast Corner of the Northeast Quarter of the Southwest Quarter of said Section 23; thence South 89°24'04" West 453.10 feet; thence South 33°24'47'' West 741.47 feet; thence South 56°35'53'' East 212.68 feet; thence South 00°35'43'' West 688.76 feet; thence South 26°53'23'' West 577.36 feet; thence North 65°36'42'' West 391.31 feet; thence North 56°35'53'' West 265.09 feet; thence South 33°24'47'' West 180.00 feet; thence South 56°35'53'' East 279.31 feet; thence South 65°36'42'' East 405.50 feet; thence South 89°24'17'' East 1031.68 feet; thence North 00°08'24" West 2119.06 feet; to the point of beginning, having an area of 1688632.71 square feet, 38.77 acres more or less and being subject to all public and private roads and easements.

A PART OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 23, TOWNSHIP 14 NORTH, RANGE 4 EAST, CRAIGHEAD COUNTY, ARKANSAS AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at the Northeast corner of the Northeast Quarter of the Northwest Quarter of said Section 23; thence South 89°13'34'' West 40.0 feet; thence South 00°35'43'' West 30.0 feet to the point of beginning proper; thence continue South 00°35'43'' West 208.72 feet; thence South 89°13'34'' West 208.72 feet; thence North 00°35'43'' East 208.72 feet; thence North 89°13'34'' East 208.72 feet; to the point of beginning, having an area of 43551.60 square feet, 1.00 acres more or less and being subject to all public and private roads and easements.
 
WHEREAS, it appears to the City Council that all applicable laws of the State of Arkansas and the City of Jonesboro have been complied with in presenting this ordinance to the City Council.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
SECTION I:  The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code should be, and it hereby is, amended so that the lands hereinabove described are zoned "RS-7" Single-Family.
 
SECTION II: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
 
SECTION III: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the lands described hereinabove so that the zoning classification of said lands shall be in accordance with the provisions of this Ordinance.
