MAPC MINUTES

AUGUST 13, 1987

body

The Metropolitan Area Planning Commission met Thursday, August 13, 1987 at 7:00 p.m. in the Council Chambers, 314 W. Washington. The items considered are as follows:

MEMBERS PRESENT: Mr. Harris, Mr. Sloan, Mr. Lusby, Mr. Vance, Mr. McCracken, Mr. Smock, Mr. Blalock

MEMBERS ABSENT: Mr. Lamberth, Mr. McDonald

The minutes of the July 9, 1987 meeting were approved as written.

Before reviewing any items Mr. McCracken informed all in attendance of a check list prepared by the MAPC to be used by the MAPC to help make sure that ll items are looked at that pertain to each project. This list was sent to all engineers, developers and architects that are frequently before the MAPC so that the items on this list could be used as a guideline as to what needs to be includes on each project. Mr. McCracken further stated that in times past some projects have lacked pertinent information that has caused items to be tabled or rejected. With the necessary information some projects cannot be evaluated as would need to be and it an effort to consider a many matters as possible and do so on a timely basis, items that are severely deficient with reference to the check list will not be placed on the agenda. The MAPC’s assistant has been directed to review items as they come in and determine what deficiencies there are and then contact the person(s) making the request and inform them o the deficiencies and let them know that if a corrected plat can be made and turned in by the due date that MAPC will attempt to consider each item. Mr. McCracken also welcomed any suggestions and/or recommendations that might be helpful in the evaluation process.

#1 Cleo C. White & Associated, Inc. Requests a rezoning of C-3 and I-1 for Lot A of Spurlock First replat to the City of Jonesboro, Ar. The general location of this property is south of Race St. The actual request is for a rezoning and a replat. The rezoning would be from R-1 to C-3 and I-1. It was pointed out that the surrounding zoning is all commercial and residential and to rezone this I-1 would constitute spot zoning, something the commission has worked very hard to prevent. A further comment was made that the existing structures on the property are not shown, something that is required on a replat.

A motion was made by Mr. Vance to approve the rezoning and the replat because the replat is contingent upon the rezoning. The motion was seconded by Mr. Blalock. Those voting aye were Mr. Blalock and Mr. Vance. Those voting no were Mr. Smock, Mr. Sloan, Mr. Lusby and Mr. Harris. MOTION FAILED.

A second motion to table this request was made by Mr. Vance and seconded by Mr. Smock. All members present voting aye. MOTION APPROVED, ITEM TABLED.

#2 Neil Stallings requests site plan approval of a storage building at 2506 E. Matthews. The general location of this property is north of Matthews and east of Washington.

Mr. Smock made a motion to approve this request subject to the plat being corrected to show the existing 40’ right-of-way and granting one (1) additional foot of right-of-way for a total of 41' from the centerline on Matthews. The motion was seconded by Mr. Harris. All members present voting aye. MOTION APPROVED.

#3 Burnis Posey requests a replat approval of Citizens replat of Lots 7, 9 & 10 of Shelby Acres, and also look at the closure of Carol Circle. The general location of this property is south of Parker Road and east of Shelby Drive.

A further request was made that the commission give their recommendation regarding the 40' drainage easement being reduced. Jeff Gibson, City Engineer, stated that a legal opinion is being sought at this time from the City Attorney as to whether a drainage easement can be eliminated or reduced. It was further stated that the adjacent property owners, some of whom have the same easement, as well as others in this area have an interest in this easement.

Another topic of discussion was the awkward angle at which Shelby Drive intersects the Frontage Road. Dan Mulhollen, representing the property owners, contended that the responsibility for correcting this lies with the Arkansas Highway Department and should have been done with the acquisition of the right-of-ways for the Frontage Road. Further discussion was directed at the possible solutions to remedy this problem.

The closing of Carol Cove was discussed at length. It was stated that if Carol Cove was not closed that Lot 7 would be of no use to the property owner. The closing of Carol Cove would require that notification be sent to all adjacent property owners informing them of the request to close the street. All the owners would have to give their consent to the closing.

A motion was made a Mr. Smock to approve the request and a second was made by Mr. Sloan. After some additional discussion both the motion and second were withdrawn.

A second motion was made by Mr. Sloan to approve this request with the following recommendations to the City Council:

1. that the right-of-way be shown on Shelby Drive as being 30' from centerline

2. that the drainage easement be reduced from 40' to 20' if the appropriate City officials and/or utilities give their permission to release it to the property owner 3. that the street right-of-way for Carol Cove be released to the property owner and if the release is approved and Carol Cove is closed that the City should get adequate right-of-way for a turning radius to facilitate right turns on to the Frontage Rd from Shelby Dr at its N end.

Mr. Sloan’s motion was seconded by Mr. Lusby. All members present voting aye .MOTION APPROVED.

#4 Mr. Vance made a motion to approve a replat of Lot 9 of Phillips Addition for Troy Phillips. The general location of this property is north of Phillips Drive. Mr. Smock seconded the motion. All members present voting aye. MOTION APPROVED.

#5 B. E. McKee requests a replat of Lot 1 of Medical Center Development Corp. The general location of this property is at the corner of E. Matthews and Rains St.

A motion to approve this request was made by Mr. Lusby subject to the revising the right-of-way on the plat back to the actual record on the west 107.51' with reference to Ordinance No. 1911. This approval is also contingent upon the owner of Lot 2 signing the replat. Mr. Harris seconded the motion. Mr. Vance was absent during the voting, all other members present voting aye. MOTION APPROVED.

There was considerable discussion about whether or not the proposed use as presented in the site plans is compatible with the present zoning which is C-3. The proposed use was stated as being a mini-warehouse type facility. Arguments for and against this proposed use by members of the commission and City officials were presented before a motion was made by Mr. Smock to approve this request. The motion was seconded by Mr. Lusby. Those voting aye were Mr. Blalock, Mr. Lusby and Mr. Smock. Those voting no were Mr. Sloan and Mr. Harris. Those abstaining were Mr. Vance. MOTION APPROVED.

#13 Tom Covington and others request approval of Country Manor Second Addition and a replat of Lots 2B & 3B of Country Manor Subdivision. The general location is north of Elkhorn Lake.

The replat and subdivision were present on the same drawing, which includes Lots 2 & 3 of the first addition and Lot 7 of the second addition. Possible legal problems in the future with clouded titles on these lots being replatted was a major concern amount the commissioners.

Mr. Vance made a motion to give preliminary approval subject to all the streets being named and redesigning the street so as to not have a right hand or left hand turn and with the recommendation that the replat and the subdivision be presented on separate drawings. Mr. Blalock seconded the motion. All members present voting aye. MOTION APPROVED.
