AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED JUNE 13, 1977, ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed with the County Court of Craighead, County, Arkansas, Western District, on May 10, 1977: and
WHEREAS, said petition for annexation of said lands was signed by all the real estate owners owning acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said petition was entered, notice was duly published of said hearing, and hearing was duly had upon said petition in the County Court on June 13, 1977, at which hearing it was duly found and declared by the Court that said petition for annexation was right and proper and that said lands hereinafter described should be annexed tot the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days have expired singe the Order of Annexation dated June 13, 1977, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated June 13, 1977, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits to the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Jon Coleman)
A part of the Northeast Quarter of the Northeast Quarter of Section 32, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Northeast corner of Section 32, Township 14 North, Range 4 East: thence West on the Section line142.9 feet to the Southwesterly right-of-way line of U.S. Highway No. 63 Bypass to the point of beginning proper; thence continue West on the Section line 1021.1 feet; thence South 1 degree 09’ West 445.5 feet; thence South 1 degree 09’ West 445.5 feet; thence South 0 degrees 54’ West 551.5 feet; thence North 89 degrees 56’ East 740.8 feet; thence North 1 degree 09’ East 210 feet; thence North 89 degrees 56’ East 45 feet; thence North 1 degree 09’ East 428.28 feet; thence North 89 degrees 56’ East 293.85 feet to the West right-of-way line of Arkansas State Highway No.173; thence North 3 degrees 27’ West on said right-of-way line 149.3 feet: thence North 0 degrees 52’ East on said right-of-way line 156.3 feet to the beginning of U.S. No 63 Bypass right-of-way line 70.3 feet to the point of beginning proper, containing 20.1 acres.
Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned and attached to Ward 5.
Section 4: The lands and territories herein annexed to the City of Jonesboro, have been zoned (C-3).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the immediate plans for development of area hereby annexed to the City of Jonesboro, Arkansas require the immediate extension of fire, police, zoning, waster and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
