Title

AN ORDINANCE AMENDING THE STORMWATER MANAGEMENT REGULATIONS OF THE STORMWATER DRAINAGE DESIGN MANAUL PROHIBITING ILLICIT DISCHARGE

Body

WHEREAS, the City Council adopted The Stormwater Drainage Design Manual on December 18, 2008 (ORD-08:099);

 

WHEREAS, the City Council passed ORD-09:063 on October 20, 2009 amending The Stormwater Management Regulations of The Stormwater Drainage Design Manual prohibiting illicit discharge

 

WHEREAS, Article 1.5, Definitions, of the Stormwater Management Regulations, is revised to clarify the definition of Pollutant as related to Regulation No. 2 published by the Arkansas Pollution Control and Ecology Commission

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:

 

SECTION 1. That ORD-09:063 passed and approved by the City Council on October 20, 2009 to amend The Stormwater Management Regulations of the Stormwater Drainage Design Manual (ORD-08:099) is hereby amended.

 

SECTION 2. That the following definition is clarified as related to illicit discharge

 

Pollutant - Anything which causes or contributes to pollution. Pollutants may include, but are not limited to: colorants, paints, varnishes, and solvents; oil and other automotive fluids; non-hazardous liquid and solid wastes and yard wastes; refuse, rubbish, garbage, litter, or other discarded or abandoned objects, ordinances, and accumulations, so that same may cause or contribute to pollution; floatables; pesticides, herbicides, and fertilizers; hazardous substances and wastes; sewage, fecal coliform and pathogens; dissolved and particulate metals; animal wastes; wastes and residues that result from constructing a building or structure; and noxious or offensive matter of any kind.

 

SECTION 3: That the provisions of this Ordinance are declared to be severable. In the event any portion or portions may be declared unconstitutional does not render the remaining provisions invalid. Further, all Ordinances and parts of Ordinances in conflict herewith are hereby repealed to the extent of said conflict.

 

SECTION 4: That the Mayor and the City Clerk are hereby authorized by the City Council for the City of Jonesboro to adopt the above referenced addition to the Stormwater Management Regulations.
