AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 4; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, a petition for the annexation of the a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on December 27, 2006; and
WHEREAS, said petition for the annexation for these lands was duly signed by all of the owners of the tract to be annexed to the City of Jonesboro, Arkansas, and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly held and held in the County Court of Craighead County, Arkansas, on January 30, 2007, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
Section 1. All of the territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of January 31, 2007, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2. The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
Part of the Northwest Quarter of the Southeast Quarter (30.66 acres) being in Section 11, Township 13 North, Range 3 East, Craighead County, Arkansas, being more particularly described as follows:
Begin at the Northeast Corner of the Northwest Quarter of the Southeast Quarter of Section 11, Township 13 North, Range 3 East, Craighead County, Arkansas: thence South 00°58’40” East along the East line of the Northwest Quarter of the Southeast Quarter of Section 11, aforesaid, 1318.53 feet to the Southeast Corner of the Northwest Quarter of the Southeast Quarter of Section 11 aforesaid: thence South 89°56’25” West along the South line of the Northwest Quarter of the Southeast Quarter of Section 11, aforesaid, 668.21 feet: thence North 00°26’25” West departing said South line, 603.98 feet: thence North 88°23’55” West 659.58 feet to the West line of the Northwest Quarter of the Southeast Quarter of Section 11, aforesaid: thence North 00°09’53” West along said West line 694.09 feet to the Southwest Corner of the Southwest Quarter of the Northeast Quarter of Section 11, aforesaid: thence North 89°53’19” East along the North line of the Northwest Quarter of the Southeast Quarter of Section 11, aforesaid, 1311.67 feet to the point of beginning. Containing in all 1, 335, 455 square feet or 30.66 acres, more or less. Subject to easements, restrictions, reservations and rights-of-way of record.
Section 3. The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward 4.
Section 4. Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning as R-1.
Section 5. It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation for the public peace, health and safety, it shall take effect and be in full force from and after its passage.
