AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on November 8, 1990: and

 

WHEREAS, said petition for the annexation of these lands was duly signed by all owners of tracts to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held on December 11, 1990, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and

 

WHEREAS, Thirty (30) days having expired since the order of annexation dated December 11, 1990, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order dated January 17, 1991;

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: All of the territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order dated January 11, 1990, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territories herein after described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

SECTION 2: The portion of lands and territory hereby annexed to a accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

A part of the North One-half of the Northeast Quarter of Section 2, Township 13 North Range 4 East described as: Beginning at the Northwest Corner of the Northwest Quarter of the Northeast Quarter of Section 2, Township 13 North, Range 4 East, thence east 642.9 feet to the Point of Beginning proper, thence continue East 1061.8 feet; thence South 00 degrees 08 minutes West 458.3 feet; thence West 378 feet; thence South 00 degrees 07 minutes 22seconds West 439.4 feet; thence North 37 degrees 13 minutes West 1127.4 feet to the point of beginning proper.

 

SECTION 3: The lands and territory annexed to the City of Jonesboro, Arkansas, and hereby accepted by the City of Jonesboro, Arkansas, are assigned and attached to Ward 6.

 

SECTION 4: Said lands and territory annexed to the City of Jonesboro, Arkansas, are hereby classified for the purpose of zoning as Residential-1 (R-1).

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in other to allow orderly growth and development of said lands and territory, therefore, and emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.

 

PASSED AND ADOPTED this 4th day of February, 1991.
