AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED JULY 10, 1978, ASSIGNING SAID ANNEXED TERRITORY TO WARD 1; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed with the County Court of Craighead County, Arkansas, Western District, on May 11, 1978; and
WHEREAS, said Petition for Annexation of said lands was signed by all the real estate owners owning acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said Petition was entered, notice was duly published on said hearing and hearing was duly had upon said Petition in the County Court on July 10, 1978, At which hearing it was duly found and declared by the Court that said Petition for Annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of Annexation was made and entered; and
WHEREAS, thirty days have expired since the Order of Annexation dated July 10, 1978, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated July 10, 1978, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits to the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: West Nettleton, west of Smoot Drive Lewis Hartley - Jon Coleman.
A part of the Southwest Quarter of the Northeast Quarter and a part of the Northwest Quarter of the Southeast Quarter, all in Section 23, Township 14 North, Range 3 East of the Fifth Principal Meridian, being more particularly described as follows: Commence at the Northwest Corner of the Northwest Quarter of the Southeast Quarter of Section 23; thence North 89°40’ East a distance of 155.0 feet; thence South 1°06’ West 235.6 feet to the centerline of an existing County Road, the point of beginning proper; thence South 88°24’ West along the centerline of aforesaid County Road 155.1 feet to the West line of the aforesaid Northwest Quarter of the Southeast Quarter of Section 23; thence South 1°06’ West 180.2 feet; thence North 88°24’ East 564.2 feet; thence North 2°21’30” West 406.9 feet to a point; thence continuing North 2°21’30” West 123.7 feet; thence South 69°41’ West 246.2 feet; thence South 2°21’30” East 271.6 feet to the centerline of an existing County Road; thence South 88°24’ West 164.0 feet to the point of beginning proper.
Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned and attached to Ward 1.
Section 4: The lands and territories herein annexed to the City of Jonesboro, Arkansas, have been zoned R-2.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the immediate plans for development of the area hereby annexed to the City of Jonesboro. Arkansas, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
