V. NEW BUSINESS
VI. OTHER COMMUNICATIONS
George Hamman with Civilogic represented property owner, Dan Freeman, regarding VR 02-17 (318 North Third Street, Jonesboro, AR). Mr. Freeman is requesting a variance to the requirement that the finished floor elevation be a minimum of one (1) foot above the Base Flood Elevation (BFE). Hamman explained it was an oversight that an intermediate flood elevation was not provided. The structure is 6” above the BFE instead of the required 1’ above the BFE required by the City. Light explained a step was skipped and new alerts have been put in place to correct situations like this one from occurring again.
Coleman asked if the City grants the variance, could the City be held responsible if the property floods at a future date. Beisner ask if a letter could be provided releasing the City of any responsibilities regarding the property. Hamman stated that the property owner would not be opposed to providing that document.
Day questioned if the variance would affect the City’s FEMA rating. Light stated FEMA will look at the number of granted variance and the City does not grant that many. The City is in a new 5-year report cycle so it will not be problem at this point.
Day stated that the variance, if granted, the variance and related information should be filed so it can be found in a title search. Coleman made the motion to accept the variance
with the stipulation that the variance and related information be recorded and filed at the courthouse before a Certificate of Occupancy (CO) issued. Day seconded. All voted Aye. Motion was passed.
Gibson stated the air conditioning unit needs to be raised to 1’ above the BFE. Hamman stated it has already been done and he will get the paperwork to Gibson.
