CITY COUNCIL MINUTES - SEPTEMBER 17, 1990

 

The Jonesboro City Council met in regular session at 7:30 p.m. at City Hall. Present were Mayor, City Clerk, City Attorney and all Aldermen.

 

The Mayor led the Pledge of Allegiance and Mr. Shelton gave the invocation.

 

Mayor Brodell recognized Allen Hicks and Jerry Brogdon for their investigative work in solving the murders and presented them plaques.

 

Representing Daughters of the American Revolution were regents Sunshine Hoffman and Roberta Sloan who presented a poster to the Mayor supporting Constitution Week. The Mayor proclaimed the week of September 17 - 23 Constitution Week and presented a Proclamation regarding same.

 

Mr. Stricklin moved, seconded by Mr. Park for the approval of minutes as corrected by the Clerk. All voted aye.  

 

Mr. Stricklin offered the following ordinance for first reading:

 

AN ORDINANCE APPOINTING COMMISSIONER FOR SEWER IMPROVEMENT DISTRICT #2; CONFIRMING VARIOUS MATTERS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

 

Mr. Stricklin moved, seconded by Mr. Nix to suspend the rules and place the ordinance on second reading. All voted aye. Mr. Stricklin moved, seconded by Mr. Evans to further suspend the rules and place the ordinance on third and final reading. All voted aye. Mr. Hinson moved, seconded by Mr. Evans for the adoption of the ordinance with the emergency clause. All voted aye. The ordinance was given the number 2297.

 

Mr. Shelton offered the following ordinance for first reading: (Rez / R -1 to C -3 S of Highland E of K Mart, Ruther)

 

AN ORDINANCE TO AMEND # 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES AND FOR OTHER PURPOSES

 

Mr. Evans moved, seconded by Mr. Shelton to suspend the rules and place the ordinance on second reading. All voted aye.

 

An ordinance regarding limiting parking o the Justice Complex parking let was tabled until the next meeting.

 

The following ordinance was on third reading:

 

AN ORDINANCE TO AMEND ORDINANCE #2206, 11.20.11 (1) LOCAL EXCEPTIONS TO THE NATIONAL ELECTRICAL CODE, TO EXEMPT MANUFACTURED HOMES CONVERTED INTO COMMERCIAL OFFICE SPACE, PREBUILT (OFF SITE) PORTABLE OFFICE BUILDINGS AND ANY TYPE SIX (6) NON-COMMERCIAL ACCESSORY BUILDINGS FROM THE CITY OF JONESBORO REQUIREMENT TO BE WIRED IN CONDUIT AND FOR OTHER PURPOSES

 

Discussion followed concerning the word temporary. Mr. Evans stated Websters dictionary defines temporary as a limited time and following a meeting with the Electrical Inspector and MAPC liaison, the time frame of 12 months was selected. He added the exemptions on commercial buildings should be limited to 12 months, with no extensions. Alderman Stricklin and Alderman Bridger objected, contending the Council should consider extensions on a case by case basis. Mayor Brodell stated mobile homes are covered by federal regulations and are exempt from the state section of the city code and that mobile homes are constructed for residential and not commercial purposes. Mr. Parks moved, seconded by Mr. Evans to amend the ordinance in section 1 (A) and (B) to read: Under extenuation circumstances, and appeal for extension of time can be made to the City Council for approval, with the limited time structure can be occupied as 12 months. A roll call vote was taken. All voted aye. Mr. Nix moved, seconded by Mr. Hinson to adopt the ordinance as amended with the emergency clause. All voted aye. The ordinance was given number 2298.                      

 

Mr. Shelton moved, seconded by Mr. Nix to set an Appeal Hearing of the MAPC at 6:50 p.m. on October 1, 1990, regarding property located on the South side of Nettleton Avenue, E. of Nelms St. by Gary Woods. All voted aye.

 

Mr. Nix moved, seconded by Mr. Shelton to set an Appeal Hearing of MAPC at 7:10 p.m. on October 1, 1990, regarding property located on the W side of Flint St., N of Jefferson Ave. for Kent Arnold. All voted aye.

 

A discussion was held regarding a replat of right-of-way of Floyd Vuncannon on property located on the S side of Nettleton Ave., E of Stadium, of a lawsuit filed in Circuit Court of Craighead County, No. CIV-89-14 against the City of Jonesboro. City Attorney, Pam Honeycutt stated she had issued a Memorandum opinion dated August 2, 1990, regarding the matter which was mailed with the agenda for the City Council to review. Mr. Mays moved, seconded by Mr. Park to have the City Attorney prepare a Quit Claim Deed and return the nine-foot strip to Floyd Vuncannon. All voted aye.

 

The Attorney for the Plaintiff, Kelly Webb asked if the City plans to reimburse Mr. Vuncannon for the temporary taking of his property. Mayor Brodell responded the City did not.

 

Mr. Shelton moved, seconded by Mr. Park to appropriate $12,000.00 for Railroad crossing bars on Commerce Drive plus additional road work needed from sales tax monies for safety measures. A roll call vote was taken and all voted aye.

 

Under New Business by Council, Mr. Hannah stated he would have a Resolution regarding non-uniformed employees, additional sick leave by the next Council meeting.

 

As Chairman of Police Committee, Mr. Hannah stated the City would need to provide a bailiff for Municipal Court. Mr. Hannah moved, seconded by Mr. Shelton to authorize one (l) additional certified police officer to serve 50% - 60% of his time performing bailiff services in Small Claims Court with money to come from Municipal Court costs. All voted aye.

 

Mr. Evans thanked Ark La and Albert Qualls for money donated toward the purchase of a drug dog. Mayor Brodell announced the Exchange Club had also donated $500.00 toward the purchase and expressed appreciation to both organizations.

 

Mr. Shelton moved, seconded by Mr. Evans to allow competitive bidding on purchase of sixteen (16) radios for the Street Dept. with money to come from fixed assets. All voted aye.

 

Dr. Strauser stated he had received a number of complaints regarding parking of large trucks on city streets preventing flow of 2-way traffic. Chief Morgan stated a local ordinance prevents said truck parking and would have officers enforce said ordinance.

 

Chief Morgan announced a Liability Seminar would be conducted by Mark Hayes of the AR Municipal League at the Ramada Inn on September 25.
