WHEREAS, the City Council adopted by reference a certain technical code entitled the Stormwater Management Drainage Ordinance on the 6^th day of June 2006. (ORD. 3641)

WHEREAS, the Stormwater Drainage committee has reviewed said Technical Code and has revised said code to clarify requirements and to better protect health and safety.

WHEREAS, the Stormwater Drainage committee advertised for public comment on changes to Technical Code named Stormwater Management Regulations and the Stormwater Design Manual.

WHEREAS, the Stormwater Drainage committee has addressed all public comments received.

WHEREAS, the Stormwater Drainage committee has approved said Technical Code and forwarded said Technical Code to City Council for adoption.

WHEREAS, pursuant to ACA 14-55-207, public notice was given of the City's intent to adopt said technical code by reference, and advertised that three (3) copies of the document were on file and available for public review and examination in the Office of City Clerk.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS THAT:

SECTION: 1      That Ordinance 3641 passed and approved by the City Council on June 6, 2006 be and is hereby repealed.

SECTION 2:      That the document entitled The Stormwater Management Regulations is hereby adopted by reference, and shall become part of the Jonesboro Municipal Code as Chapters 16.1 through 16.8.

SECTION 3:      That the document entitled The Stormwater Drainage Design Manual is hereby adopted by referenced.

SECTION 4:      That nothing in this ordinance or in the code hereby adopted shall be constructed to affect any suit or proceeding or existing, under any act or ordinance hereby amended as cited in Section 2 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired of affected by the ordinance.
