AN ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING WEST FROM WALNUT STREET

BE IT ORDAINED by the Mayor and Council of the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 16th day of February, 1953, asking the City Council to vacate and abandon that portion of the alley designated on the plat of B.H. Berger’s Subdivision of Block 1 of Nisbett’s Second Addition to the City of Jonesboro, Arkansas, as same appears in Deed Record 43, page 104 in the office of the Circuit Clerk at Jonesboro, Arkansas, designated as follows, to wit:
(1) A ten foot (10’) alley running West from Walnut Street in B.H. Berger’s Subdivision of Block One (1) of Nisbett’s Second Addition to the City of Jonesboro, Arkansas, said alley being ten feet (10’) in width and one hundred, ninety feet (190’) in length. Said alley does not run entirely through said block and the West end of said is a dead end; and
WHEREAS, after due notices as required by law, the City Council has, at the time and place mentioned in the notices, heard all persons desiring to be heard on the question and has ascertained that the alley hereinabove described has heretofore been dedicated to the public use as an alley; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all the owners of the property abutting the portion of the alley to be vacated have filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1. The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley designated as follows:
(1) A ten foot (10’) alley running West from Walnut Street in B.H. Berger’s Subdivision of Block One (1) of Nisbett’s Second Addition to the City of Jonesboro, Arkansas, said alley being ten feet (10’) in width and one hundred, ninety feet (190’) in length. Said alley does not run entirely through said block and the West end of said is a dead end.
SECTON 2. A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the County and recorded in the deed records of the County.
SECTION 3. This ordinance shall take effect and be in force from and after its passage.
