AN ORDINANCE ESTABLISHING THE SOUTHVIEW ACRES STREET IMPROVEMENT DISTRICT NUMBER 1; AND FOR OTHER PURPOSES

WHEREAS, the parties claiming to be the owners of a majority in value as shown on the last county assessment of the property located within the district herein described have filed a petition praying that a street improvement district be established for the purposes hereinafter set forth; and
 
WHEREAS, after due notice as required by law, the City Council and City of Jonesboro, Arkansas, held a public hearing to meet and hear all owners of real property in the proposed district desiring to be heard and has found and ruled that the petition contains the signatures of the majority in value of the real property owners within the said district; and
 
WHEREAS, the aforesaid petition should be approved and that the proposed street improvement district should be established in accordance with the A.C.A. ' 14-322-101, et seq., and other applicable laws of the State of Arkansas.
 
NOW THEREFORE, IT IS ORDAINED by the City Council for the City of Jonesboro, Arkansas:
 
SECTION 1: There is hereby established a street improvement district embracing the following real property with improvements:
 
Part of Section 12, Township 13 North, Range 3 East, Craighead County, Arkansas, being more particularly described as follows:  Begin at the Southeast Corner of Section 12, Township 13 North, Range 3 East; thence North 0° 17' East along the East line of said Section 12, 1281.9 feet; thence West 2526.6 feet to the point of beginning proper; thence along an agreed property line fence as follows:  South 88° 00' West 218.5 feet, North 88° 56' West 195.9 feet, North 3° 56' East 30.2 feet, North 88° 37' West 162.5 feet, North 88° 28' West 287 feet, North 88° 48' West 210.1 feet, North 87° 34' West 269 feet, North 87° 06' West 277.5 feet, North 20° 08' East 2827.4 feet, North 20° 35' East 421 feet to the centerline of a Public Road; thence South 56° 30' East along said centerline 360.2 feet; thence South 27° 57' West 332.8 feet; thence South 71° 34' East 485.7 feet; thence North 16° 11' East 185.9 feet to the centerline of Public Road aforesaid; thence along said centerline of Road as follows:  South 48° 05' East 250.8 feet, South 47° 30' East 175.9 feet, South 44° 37' East 196.3 feet, South 48° 25' East 164.8 feet, South 50° 51' East 35 feet, South 52° 36' East 99.8 feet, South 53° 09' East 141.5 feet to the intersection of said centerline of Road and the centerline of a Ditch; thence along said centerline of Ditch as follows:  South 27° 40' West 94.3 feet, South 57° 57' West 319.6 feet, South 44° 40' West 139.5 feet, South 2°36' West 70.7 feet, South 19° 50' West 882 feet, South 27° 11' West 221.6 feet, South 12° 30' West 288.4 feet, South 40° 16' West 57.7 feet, South 13° 47' West 175.4 feet to the point of beginning proper, containing 96.09 acres and being subject to easements for a Public Road along the North side of the tract and for a Ditch along the East side of the tract.
That the purpose of the establishment of said improvement district shall be to pay for the necessary improvements to the streets within the Southview Acres Subdivision along with all necessary and incidental thereto, including, but not limited to, grading, roadbed preparation and the paving of said road and a sufficient amount as determined by the Board of Commissioners shall be assessed against the real property within the district as allowed by applicable state law as set forth hereinafter.
 
SECTION 2: Said street improvement district shall be known as Southview Acres Street Improvement District No. 1.  That Patrick Brewer, Ricky Martin and Kevin Carpenter shall be and are hereby appointed Commissioners to serve on the Board of Commissioners with authority to make assessments and carry out the improvements provided hereinabove.
 
SECTION 3: That the property owners within the district shall pay the amount of assessments in one lump sum payment or in five equal annual installments with interest per annum at the maximum rate allowed by Arkansas law.  That the first annual installment shall be collected by the county collector along with the general taxes as provided by law and that the second and subsequent annual installment shall be paid at a time provided by law for paying general taxes with regards to real property.
 
SECTION 4: Due to the fact that Southview Acres Street Improvement District is an important traffic artery to the City of Jonesboro, an emergency is hereby declared to exist and, therefore, this ordinance, being necessary for the preservation of the public peace, health and safety of the citizens of the City of Jonesboro, shall take effect immediately and be in full force from and after its passage.
