AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MARCH 18, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 5, ZONING SAID ANNEXED TERRITORY COMMERCIAL C-3 AND RESIDENTIAL R-1, RESPECTIVELY, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described as duly filed with the County Clerk of Craighead County, Arkansas, Western District, on January 9, 1976; and

 

WHEREAS, said petition for the annexation of said lands was signed by all property owners owning the acreage annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing on said petition was entered, and notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court on the 13th day of February, 1976, at 10:00 a.m., at which hearing it was duly found and declared by the court that said petition for annexation was made and entered; and

 

WHEREAS, thirty (30) days have expired since the order of annexation dated February 13, 1976, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas;

 

Section 1:  That territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, Dated March 18, 1976, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants within the new annexation shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

All of the Northeast Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, less and except the following tracts:

 

Tract No.1: Begin at the Northwest Corner of the said Northeast Quarter of Southwest Quarter; thence run East 91 feet to the East side of the county road; thence in a Southwesterly course along the meanderings of said road to the intersection of said East line of said road with the West line of said Northeast Quarter of the Southwest Quarter; thence North along the West line of said Northeast Quarter of the Southwest Quarter to the point of beginning, containing ½ acres, more or less;

 

Tract No.2: Begin at the Southwest corner of said Northeast Quarter of the Southwest Quarter; thence run North 630 feet; thence run East 210 feet; thence run South 210 feet; thence run East 95 feet; thence run South 420 feet; thence run West 305 feet to point of beginning, containing 3.94 acres, more or less, and containing less said exceptions 35.56 acres, more or less;

 

A part of the Northeast Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, more particularly described as follows:

 

Begin at the Southwest corner of said Northeast Quarter of the Southwest Quarter; thence North 420 feet; thence East 305 feet; thence South 420 feet; thence West 305 feet to the point of beginning, containing three acres, more or less;

 

A part of the Northwest Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, being more particularly described as follows:

 

Begin at the Southeast corner of said Northwest Quarter of the Southwest Quarter and run thence South 88 degrees 58 minutes West 208.2 feet; thence run North 1° 16’ West 87.3 feet; thence run North 56° 47’ 53” East 36.5 feet; thence run North 45°36’ East 241.0 feet; thence run South along the Quarter Section line 377.9 feet to the point of beginning;

 

The East 198 feet of the Southwest Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East; All that part of the West Half of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, lying south of the Jonesboro-Cash Public Road, less and except the East 198 feet thereof and 2.4 acres out of the Northwest corner;

 

All of the Southeast Quarter of the Southeast Quarter of Section 22, Township 14 North, Range 3 East, less and except one acre square in the Southwest Corner thereof, containing, less said exception, 39 acres, more or less;

 

The East 532 feet of the Southwest Quarter of the Southeast Quarter of Section 22, Township 14 North, Range 3 East, less and except one acre off the Southwest corner thereof, containing 15 acres, more or less, which property adjoins the City of Jonesboro, Craighead County, Arkansas.

 

Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City and assigned and attached to Ward 5.

 

Section 4: The following described lands and territory, which are annexed to the City of Jonesboro are hereby zoned Commercial C-3 and are described as follows, to-wit:

 

All of the Northeast Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, less and except the following tracts:

 

Tract No. 1: Begin at the Northwest corner of the said Northeast Quarter of the Southwest Quarter; thence run East 91 feet to the East side of the County Road; thence in a Southwesterly course along the meanderings of said road to the intersection of said east line of said road with the west line of said Northeast Quarter of the Southwest Quarter; thence North along the West line of said Northeast Quarter of the Southwest Quarter to the point of beginning, containing one-half acre, more or less;

 

Tract No. 2: Begin at the Southwest corner of said Northeast Quarter of the Southwest Quarter; thence run North 630 feet; thence run East 210 feet; thence run South 210 feet; thence run East 95 feet; thence run South 420 feet; thence run West 305 feet to point of beginning, containing 3.94 acres, more or less; and containing, less said exceptions, 35.56 acres, more or less;

 

A part of the Northwest Quarter of the Southwest Quarter of Section 23, Township 14 North Range 3 East, more particularly described as follows:

 

Begin at the Southeast corner of said Northwest Quarter of the Southwest Quarter and run thence South 88°58’ West 208.2 feet; thence run North 1°16’ West 87.3 feet; thence run North 56°47’ 53” East 36.5 feet; thence run North 45°36’ East 241.0 feet; thence run South Along the quarter section line 277.9 feet to the point of beginning proper;

 

A part of the Northeast Quarter of the Southwest Quarter of Section 3, Township 14 North, Range 3 East, more particularly described as follows:

 

Begin at the Southwest corner of said Northeast Quarter of the Southwest Quarter; thence North 420 feet; thence East 305 feet; thence South 420 feet; thence West 305 feet to the point of beginning, containing 3 acres, more or less.

 

Section 5: The following lands and territory which are annexed to the City of Jonesboro are hereby assigned a zoning classification of Residential R-1 and are hereby described as follows, to-wit:

                     

The East 198 feet of the Southwest Quarter of the Southwest Quarter of Section 23, Township 14 North, Range 3 East; all that part of the West Half of the Southwest Quarter of Section 23, Township 14 North, Range 3 East, lying South of the Jonesboro-Cash Public Road, less and except the East 198 feet thereof, and 2.4 acres out of the Northwest corner; all of the Southeast Quarter of the Southeast Quarter of Section 22, Township 14 North, Range 3 East, less and except one acre square in the Southwest Quarter thereof, containing, less and said exceptions, 39 acres, more or less;

 

The East 532 feet of the Southwest Quarter of the Southeast Quarter of Section 22, Township 14 North, Range 3 East; less and except one acre off the Southwest corner thereof, containing 15 acres, more or less.

 

Section 6: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water and other protections and benefits in order to allow the orderly growth and development of said lands and territory, and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage and approval.
