AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY RESIDENTIAL R-2; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on February 21, 1979; and
WHEREAS, said Petition for the annexation of said lands was duly signed by the sole owners of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas on March 30, 1979, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of annexation was made and entered; and,
WHEREAS, thirty (30) days having expired since the Order of annexation dated March 30, 1979, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory in said lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of March 30, 1979, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original City Limits of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
A part of the South Half of the Southwest Quarter of the Northeast Quarter of Section 29, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Southwest corner of aforesaid Southwest Quarter of the Northeast Quarter; thence North 89° 02’ East on the 40 acre line 50 feet; thence North 0° 11-1/2’ East 50 feet to the North right-of-way line of Race Street; thence North 89° 02’ East along said right-of-way line 149 feet; thence South 89° 03’ East along said right-of-way 600.34 feet; thence North 89° 02’ East along said right-of-way line 212.4 feet to the point of beginning proper; thence North 0° 11-1/2’ East 627.76 feet to the North line of said South Half of the Southwest Quarter of the Northeast Quarter; thence North 89° 05’ East on the 20 acre line 282.37 feet to a point 30 feet from the East line of aforesaid 20 acre tract; thence South 0° 04’ West 30 feet from and parallel to the East line of aforesaid 20 acre tract 627.49 feet to the North right-of-way line 283.74 feet to the point of beginning proper, containing 4.08 acres. To the City of Jonesboro, Craighead, County, Arkansas.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6 of the City of Jonesboro.
Section 4: The said lands and territory annexed to the City of Jonesboro are hereby zoned residential R-1.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection benefits and that said benefits and protection are urgently needed in order to allow orderly growth and development of said lands and territory, therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage.
