AN ORDINANCE ABANDONING A PORTION OF RIGHT-OF-WAY LOCATED IN JONESBORO, ARKANSAS

WHEREAS, the City Council of the City of Jonesboro, Arkansas, at its regular meeting hearing the request to abandon the Rights-of-Way as shown on the Plat of North Acres Subdivision;
For purposes of the legal description, a plat has been attached, and is known as "Plat of Survey - North Acres Apartments, Pine and Warren Streets, Jonesboro, Arkansas" dated 08/12/71, and last revised 08/26/71, hereinafter referred to as "The Plat".
LEGAL DESCRIPTION:
(A) All of Novak Street (marked on site as Garden Manor);
(B) All of Miller Street;
(C) A portion of Warren Street being all that Right-of-Way east of a line sixteen point four feet (16.4) east of the center-line of Warren Street; and
(D) All of Bridge Street, less and except a strip of land thirty-two feet (32') in width, said strip being twelve and nine tenths feet (12.9') to the west of the center-line of Bridge Street, and nineteen and one tenth feet (19.1') east of the center-line of Bridge Street;
(E) Subject to the abandonment of the Rights-of-Way as described above, Mr. Craft further agrees to install a sidewalk four feet (4') in width, to be constructed two (2) feet East of the existing curb on the East side of Bridge Street and extending four (4) feet in width to the East right-of-way line of said Bridge Street. Mr. Craft further agrees that said sidewalk will be installed prior to a fence being constructed on the West side of Bridge Street enclosing the existing sidewalk.
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the abandonment of the aforementioned Rights-of-Way would not affect the use of and would be in the best interest of all parties concerned;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights, together with the right of the public generally, in Jonesboro, Arkansas.
SECTION 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of Craighead County, as Jonesboro, Arkansas and recorded in the Deed Records of Craighead County, Arkansas
SECTION 3: The closing, vacating, and abandonment by the City of its rights and the rights of the public generally in the above described portion of the Rights-of-Way is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and the ordinance being necessary for the protection and promotion of the public health, welfare, and safety, the same shall take effect from and after its passage and approval.
