METROPOLITAN AREA PLANNING COMMISSION 

JUNE 13, 1995 

 

MEMBERS PRESENT: Coleman, Damron, Finley, Beadles, Shaw and Phillips 

 

MEMBERS ABSENT: Little, McCracken and Pitts 

 

Minutes of the May 9, 1995 meeting were approved as submitted.

 

#1  SU95-5  Nellie Jackson requested approval of placement of a mobile home at 1622 S. Kathleen Street, between Morton and Mitchell Streets. 

 

Item WITHDRAWN.

 

#2  SU95-6  Karen Gambill requested approval of placement of a mobile home on the east side of Pinehill Lane, north of Craighead Forest Road. 

 

Mr. Damron moved to approve the request, seconded by Dr. Beadles.  Three voted aye, two no, REQUEST APPROVED. 

 

#3  SU95-7  Kenny and Valerie Parish requested approval of placement of mobile home at 3317 Moore Road. 

 

Ms. Finley made a motion to approve the request seconded by Ms. Shaw.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#4  SU95-8  Rickie and Dixie White requested approval of placement of a mobile home on the north side of Curtis Road, east of Walters Road.

#5  RZ95-19  W. B. Lacy, III requested approval of rezoning from   R-1 to C-3 for 17.72 acres located on the west side of Hwy. 63 Bypass, north of Strawfloor Drive and extending north of W. Washington Avenue. 

 

There was much discussion about rezoning a strip of land approximately 200' wide and one half mile long along a controlled access road.  It was stated that direct access to the 63 Bypass would be limited. 

 

A street would probably have to be built on site to provide access to any development. Commissioners stated they felt that the rezoning should go to a greater depth than proposed.  It was questioned if the property was to be used for billboards.  Mr. Lacy state that he had no plans for this type of use.

 

Ms. Shaw stated that she felt commercial zoning would be appropriate in this area but would need a greater depth than shown.  Ms. Shaw moved to approve the request as submitted.  Mr. Damron seconded, 0 voted aye, 5 voted no, REQUEST DENIED. 

 

#6  RZ95-20  Steve Daugherty requested approval of rezoning from AG-1 to C-3 for 1.87 acres located on the south side of Highland Drive, west of Moore Road. 

 

Adjoining properties were changed to C-3 in the last two years and other lands in the area were zoned I-1.

 

Mr. Phillips moved to approve the request, seconded by Ms. Finley.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#7  MP95-31  Steve Daugherty requested approval of a minor plat containing 1.87 acres located on the south side of Highland Drive, west of Moore Road. 

 

Mr. Damron made a motion to approve the request, seconded by Mr. Phillips.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#8  RZ95-21  Melissa Meredith requested approval of rezoning from R-1 to I-1, Lots 1, 1A, 4 & 5, all in Block B of Apple Hills Subdivision. The property is located on the east side of Warren Street, between Jonathan Street and Daybreak Drive. 

 

Several issues concerning violations of the bill of assurance for this subdivision.  It was stated that the existing building was built prior to annexation and zoning laws.  A new owner desires to purchase the building and adjoining property for light industrial uses.  It was recommended that the owners pursue research the amendments to the bill of assurance already or come up with some other remedy so that rezoning could be considered.  The Chairman informed those in attendance that the City does not enforce bills of assurance but should consider them when they are provided.

#9  RZ95-22  Steve Stoker requested approval of rezoning from R-3 to C-3 for the north one half of Lots 1 and 2 of Block 4 of Meyers Addition.  The property is located on the east side of Church Street, north of Allen Avenue. 

 

The adjoining neighbor on the north side objected to the rezoning but mostly stated concern about the encroachment of his own house onto Mr. Stoker's property.  Mr. Stoker stated that he had no intention of claiming the property where the house encroaches.  Several commercial and industrial uses exist in the area now.  Many of the residences are in a rapidly declining state.

 

Ms. Shaw moved to approve the rezoning, seconded by Dr. Beadles.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#10  RP95-23  Steve Stoker requested approval of a replat of Lots 1 & 2, Block 4 of the Meyers Addition.  The property is located on the east side of North Church Street, north of Allen Avenue. 

 

Ms. Finley made a motion to approve the replat request, subject to the owner providing a six foot privacy fence on the north and east sides of the property or where residential uses are.  Ms. Shaw seconded with five voting aye, 0 no, REQUEST APPROVED WITH STIPULATION. 

 

#11  RZ95-23  Max Dacus, Jr. requested approval of a rezoning from R-3 to C-3 for Lot 1, Block B of Washington Grove and a part of the east half of the SE 1/4 of Section 14, T14N, R3E.  The property is located on the north side of W. Washington Avenue, west of Stratford Drive.

 

Ms. Shaw moved to approve the rezoning and the replat as submitted with a 10' drainage easement on the west property line.  Mr. Damron seconded, five voted aye, 0 no, REQUEST APPROVED WITH STIPULATION. 

#12  RZ95-24  Kent Arnold requested approval of rezoning from R-1 to R-3 for 78.49 acres located on the west side of Caraway Road, south of Glenn Place. 

 

Mr. Arnold stated that all of his developments have occurred in R-2 zoning.  Two subdivisions Mr. Arnold developed in the vicinity were rezoned R-3 prior to development.  No opposition was expressed concerning this request.  Lands north and east are zoned C-3. 

 

Ms. Shaw moved to approve the rezoning, seconded by Mr. Damron.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#13  PP95-10  Kent Arnold requested preliminary approval of subdivision plans containing 38 lots on 10 acres.  The property is located on the north side of Harrisburg Road, east of Caraway Road and west of Stadium Boulevard. 

 

Mr. Phillips made a motion to accept for preliminary approval with the following stipulations: 

1.  Agreement in writing from A P & L for using easement for street purposes

2.  Final plat to show location of poles and how they should be buffered 

3.  Complete plat and utility, drainage and street plans to be shown on final plan

Mr. Damron seconded the motion, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#14  RZ95-25  LaVaughn Rusher requested approval of rezoning from R-1 to C-3 for 1.12 acres located on the south side of Johnson Avenue, east of Airport Road. 

 

Dr. Beadles moved to approve the rezoning, seconded by Ms. Shaw.  Five voted aye, 0 no, REQUEST APPROVED. 

 

#14A Replat of above property.

 

Ms. Shaw made a motion to approve the replat subject to 10 additional feet of right of way for 60' from centerline and remove all wrecked cars from property within 60 days.  Ms. Finley seconded with 5 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#15  FP95-9  Skip Macon requested final approval of subdivision plans for Macon's Addition containing 5 lots on 18.58 acres.  The property is located on the south side of Race Street, east of Fair Park Blvd. 

 

Ms. Shaw moved to approve the request subject to:

1.  Engineer's seal and signature on plat

2.  5' utility easement adjacent to street right of way

3.  FEMA map amendments

4.  Both sides of street construction to be done at same time with shared cost if possible

5.  20' drainage easement off site is not a recorded easement of record 

Dr. Beadles seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#16  FP95-10  Mike Cameron requested final approval of plans for redeveloping portions of the B. H. Berger Subdivision and the East End Addition.  The property is located on the south side of Aggie Road, and is a continuation of Azalea Lane. 

 

Ms. Shaw made a motion to approve the request with the following stipulations:

1.  An additional 5' of right of way on Aggie Road

2.  Drop inlet details on plans

3.  Engineer's signature and seal on plans

Ms. Finley seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#17 RP95-25  Harold Jelks requested approval of a replat of Lots 1, 2, 3 and 4 of Wilson's Second Addition.  The property is located on the northeast corner of Huntington Avenue and Gee Street. 

 

Mr. Damron moved to approve the request subject to a street improvement agreement with right of way.  Ms. Shaw seconded, four voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATION. 

 

#18  SP95-8  Jonesboro Public Schools requested approval of a minor plat and site plans for the Philadelphia Elementary School.  The property is located on the south side of Thomas Green Road, east of Highway 141 North. 

 

Mr. Damron moved to approve the minor plat and site plan noting that the requirements of the fire department had been complied with and subject to approval of a resolution by city officials concerning street right of way was presented by Donn Mixon.  Ms. Shaw seconded, five voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#19  Crowley Ridge Girl Scout Council requested approval of site plans for a new office to be located on the southeast corner of Johnson Avenue and Murray Creek Drive.

 

Mr. Phillips moved to approve the request subject to the engineer or surveyor doing the site plan to meet specifications and submit to staff for approval.  Ms. Finley seconded, four voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATION.
