BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows:

 

From Residential (R-1) to Commercial (C-3) of properties described as follows:

 

Part of the Northeast Quarter of the Southwest Quarter of Section 33, Township 14 North, Range 4 East, being more particularly described as follows:  Begin at the Southwest Corner of the Northeast Quarter of the Southwest Quarter of said Section 33; thence North 00o11'08' West 40.00 feet to a point on the North right of way of Planters Drive; thence North 88o58'51" East along the North right of way of Planters Drive 896.56 to the point of beginning proper; thence  North 00o21'28" West 276.67 feet to a point on the South Bank of Higginbottom Creek; thence with the meanderings of said South Bank as follows:  South 58o17'15" East 68.93 feet; South 52o15'49" East 136.13 feet; South 80o16'07" East 166.88 feet to a point on the Westerly right of way of Arkansas Highway No. 1; thence South 01'39'24" East along said Westerly right of way 123.06 feet to the North right of way of Planters Drive; thence South 88o58'51" West along said North right of way 332.66 feet to the point of beginning proper, containing 1.36 acres, more or less, subject to all rights of way and easements of record;

 

Begin at the Northwest Corner of the East Half of the Southwest Quarter of Section 33, Township 14 North, Range 4 East; thence South 00o11'08" East on the 40 acre line 1315.50 feet to the South line of Planters Drive; thence North 88o58'51" East along said line 1088.69 feet to the point of beginning proper; thence North 88o58'51" East along said line 140.42 feet to the West right of way line of Arkansas Highway No. 1 (Stadium Boulevard); thence South 00o03'35" West along said right of way line 120.00 feet; thence South 88o58'51" West 139.91 feet; thence North 00o11'08" West 120.00 to the point of beginning proper, containing 0.39 acres, more or less, less and except the North 10 feet thereof, subject to all easements and rights of way of record;

 

Begin at the Northwest Corner of the Southeast Quarter of the Southwest Quarter of Section 33, Township 14 North, Range 4 East; thence South 0o11'08" East on the forty acre line 120.00 feet to the point of beginning proper; thence North 88o58'51" East 1228.60 feet to the West right of way line of Arkansas Highway No. 1; thence South 0o56'22" East along said right of way line 519.94 feet; thence South 88o58'49" West 1235.44 feet to the forty acre line; thence North 0o11'08" West on the Forty acre line 520.00 feet to the point of beginning proper, containing 14.71 acres, more or less; and Begin at the Northwest Corner of the Southeast Quarter of the Southwest Quarter of Section 33, Township 14 North, Range 4 East; thence South 0o11'08" East on the forty acre line 640.00 feet to the point of beginning proper; thence North 88o58'49" East 1235.44 feet to the West right of way line of Arkansas Highway No. 1; thence South 0o55'18" East along said right of way line 275.44 feet; thence South 88o59'59" West 570.19 feet; thence South 0o07'39" West 400.26 feet to the section line; thence South 88o58'48" West on the section line 666.60 feet to the forty acre corner; thence North 0o11'08" West on the 40 acre line 675.50 feet to the point of beginning proper, containing 13.95 acres, more or less, subject to all rights of way and easements of record.

 

SECTION 2: It is found and declared by the City Council that proper use of the tract of land described in this Ordinance is being delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect from and after its passage and approval.
