MEMBERS PRESENT: Mr. Sloan, Mr. Blalock, Mr. Coleman, Mr. Vance, Mr. McCracken, Mr. Aycock, Mr. Patteson

 

MEMBERS ABSENT: Mr. Lamberth

 

The minutes of the June 12, 1990 meeting were approved as prepared.

 

#1  An ordinance to amend Chapter 14.08, District Regulations of the Code of Ordinances of the City of Jonesboro, creating a new section for the purpose of definitions and specifically  define “yard”.

 

A motion was made by Mr. Vance and seconded by Mr. Aycock to recommend to the City Council that this ordinance be approved. Voting was 5 in favor, 0 opposed. MOTION APPROVED.

 

#2  An ordinance to amend Ordinance #2257, Mobile Homes and Mobile Home Parks, Section

14.20.02, ( 3 ) to specify that the procedure for notification to adjacent property owners of a proposed manufactured housing subdivision shall be the same as for a residential planned unit development.

 

A motion was made by Mr. Patteson and seconded by Mr. Vance to recommend to the City Council that this ordinance be approved.  Voting was 5 in favor, 0 opposed. MOTION APPROVED.

 

A further motion was made by Mr. Vance to strongly recommend to the City Council that they approve an ordinance to amend Ordinance #2257, Section 14.20.04, Individual Mobile Home or

Manufactured Homes not in Subdivision, Park or Court - Special Use, to allow placement of same in the R-1 zoning district, Mr. Sloan seconded the motion. MOTION APPROVED.

 

#3  RZ90-23 Mona Kay requested rezoning from R-1 to R-2 for Lots 34 & 35 of the Ruth Ann Subdivision.  The property is located on the west side of Holmes Road, at the south end of Holmes Road. ITEM WITHDRAWN.

 

#4  RP90-26  Mona Kay requested approval of Lot l, Kay’s Addition, a replat of Lots 34 & 35 of Ruth Ann Subdivision.  The property is located on the west side of Holmes Road, at the south end of Holmes Road. ITEM WITHDRAWN.

 

#5  RZ90-24  William Jennings requested rezoning from R-1 to R-2 for .92 acre located on a part of the NW 1/4, SE 1/4  of Section 5, T14N, R4E.  The property is located on the east side of Prescott Lane, south of Magnolia Road.

 

Mr. Vance made a motion to approve this request subject to the 30' road easement being changed to 30' right-of-way and subject to the owner signing a street improvement agreement to pay his prorate share of improvements on Prescott Lane. Mr. Aycock seconded the motion. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#7  RZ90-25  George Perkins requested rezoning from R-2 to C-5 for a part of Block 21 of  Knight’s First Addition.  The property is located on the west side of Main Street, south of Cherry Avenue and east of Union Street.

 

Mr. Coleman made a motion to approve this request subject to the right-of-way being changed to reflect 50' from centerline on Main Street as shown on the Master Street Plan. The motion was seconded by Mr. Aycock. Voting was 4 in favor, 3 opposed.  Approved requires 5 affirmative votes, therefore MOTION FAILED, REQUEST DISAPPROVED.

 

A motion by Mr. Vance and a second by Mr. Blalock to approve the rezoning subject to meeting the right-of-way requirements on Main Street was withdrawn before voting.

 

A further motion by Mr. Vance and seconded by Mr. Patteson to take a straw vote to see if the Commission would look favorable at rezoning all the property owned by Mr. Perkins subject to the right-of-way requirements on Main Street was also withdrawn prior to voting.

 

#8  RZ90-26  Bretz Presley requested rezoning from R-1 to AG-1 for 4.09 acres located on a part of the NW 1/4, SE 1/4 of Section 9,  T13N,  R4E.  The property is located east of Kings Point Lane, at the east end of Waymon Road.

 

Mr. Patteson made a motion to approve this request subject to a 30' right-of-way being shown on Kings Point Lane and subject to the owner signing a street improvement agreement for the same street.  Mr. Aycock seconded the motion. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#9  MP90-27  Bretz Presley requested approval of a two lot subdivision containing  4.09 acres. The property is located east of Kings Point Lane, at the east end of Waymon Road.

 

Mr. Vance made a motion to approve this request subject to a 30' right-of-way being shown on Kings Point Lane and subject to the owner signing a street improvement agreement for the same street.  Mr. Patteson seconded the motion. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

A further motion was made by Mr. Vance and seconded by Mr. Coleman to reconsider item #9. Voting was 5 in favor, l opposed. MOTION APPROVED.

 

Mr. Vance made a motion to table this request considering the fact that Tract 2 has no frontage on a dedicated street on any side. Voting was 6 in favor, 0 opposed. REQUEST TABLED.

 

#10  RZ90-27  Charles Presley requested rezoning from R-1 to AG-1 for 8.60 acres located on a part of the SE 1/4, NE 1/4 of Section 9,  T13N, R4E.  The property is located north of Waymon Road and east of Kings Point Lane.

 

Mr. Vance made a motion to approve this request subject to the right-of-way on Waymon Road

being shown as 30' from centerline and subject to the owner signing an agreement for street  improvements on Waymon Road.  The motion was seconded by Mr. Sloan. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#11  RZ90-28  Robert Chastain requested rezoning from R-1 to R-3 for Lots 1-5 of the west ½ of Lot 5 of Cobb & Lee Survey.  The property is located on the southeast corner of Belt Street and Patrick Street.

 

A motion to approve this request was made by Mr. Vance subject to the owner signing a street improvement agreement for Patrick Street and Belt Street,  Mr. Aycock seconded the motion. Voting was 6 in favor, 0 opposed . REQUEST APPROVED WITH STIPULATIONS.

 

#12  RP90-27  Robert Chastain requested a five lot replat of the west ½ of Lot 5 of Cobb & Lee Survey.  The property is located on the southeast corner of Belt Street and Patrick Street.

 

A motion to approve this request was made by Mr. Vance subject to the owner signing a street improvement agreement for Patrick Street and Belt Street.  Mr. Coleman seconded the motion. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#13  MP90-28  Robert Chastain requested four lot minor plat containing 3.21 acres.  The property is located on the west side of Valley Ridge Lane, south of Valley View Road.

 

Mr. Vance made a motion to table this request so that a complete subdivision plan may be submitted for approval. Mr. Vance further stated that if possible, preliminary and final approval may be granted at the next meeting. The motion was seconded by Mr. Aycock. Voting was 6 in favor, 0 opposed. REQUEST TABLED.

 

#14  RZ90-29  Clarence and Dorothy Byford requested rezoning from R-1 to C-3 for .50 acre located on a part of the located on the west side of Highway 49, south of Wood Street.

 

Mr. Coleman made a motion to approve this request subject to the right-of-way being shown as 50' from centerline on Highway 49. Mr. Patteson seconded the motion. Voting was 6 in favor, 0 opposed.  REQUEST APPROVED WITH STIPULATIONS.

 

A further motion was made by Mr. Vance and seconded by Mr. Sloan that the drawing be revised to make this a minor plat and the plat be signed when submitted. Voting was 6 in favor,

0 opposed. MOTION APPROVED.

 

#16  FP90-4 Marie and Anita Parker requested final approval of Creekwood Addition Phase I, containing 9 lots on 3.75 acres. The property is located on Quail Dr. at the west end of Pinoak Pl. A motion to approve this request was made by Mr. Coleman and seconded by Mr. Vance.  Voting was 6 in favor, 0 opposed. REQUEST APPROVED.

 

#17  PP90-6  Richard White requested preliminary approval of Oakridge Estates Phase II.  The subdivision contains 21 lots and is located east of Scotchwood Drive, off Highway 351, at the east end of Oak Ridge and Oak Vista Drives.

 

A motion to grant conceptual approval of this subdivision pending submittal of complete sub- division plans according to city specifications was made by Mr. Vance and seconded by Mr. Sloan. Voting was 6 in favor, 0 opposed. CONCEPTUAL APPROVAL GRANTED.

 

#18 RP90-23 Carroll Caldwell requested approval of a replat of Lots 8 & 9, Block C, Marshall Estates. The property is located at the north end of E. Lakeshore Cove, south of Matthews Ave.

 

Mr. Vance made a motion to approve this request subject to the owner signing an agreement stating that he will be responsible for twelve months for correcting any drainage problems that may arise after the wet weather ponds are deleted. Mr. Vance further stated that this action is not a statement of policy that we disagree with detention facilities. The motion was seconded by Mr. Coleman. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#19  RP90-24  Keith Boyer requested approval of Lot 2A, a replat of Lot 2, Wooded Acres Sub- division. The property is located on the west side of S. Caraway Road, north of Lawson Road.

 

Mr. Patteson made a motion to approve this request subject to the owner signing a street improvement agreement for Caraway Road. The motion was seconded by Mr. Vance. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#20  RP90-25  Stephen Orr requested approval of Lot 8A, a replat of Lot 8 and the north ½ of Lot 9, Castle Heights Addition. The property is located on the east side of Castle Drive.

 

A motion to this request was made by Mr. Vance and seconded by Mr. Patteson. Voting was 3 in favor, 4 opposed, MOTION DISAPPROVED.

 

A motion was made by Mr. Sloan to approve this request but that it not be recorded until the south half of Lot 9 has been replatted as part of a legal lot.  Mr. Vance seconded the motion. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#21  RP90-29  Joe Murrey requested a replat of Lots 4 & 5, Block B of High Meadow 2nd Sub-division and Lot 14, Block C of Timber Trails Addition. The property is located on the west side of Turtle Creek Road, at the east ends of Pinewood Circle and Sparrow Circle.

 

Mr. Vance made a motion to approve this request subject to the right-of-way being shown as not less than 30' from centerline on Turtle Creek. The motion was seconded by Mr. Aycock. Voting was 6 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#22  MP90-29  Manny Medina requested approval of a one lot subdivision containing 3.719 acres.  The property is located on the north side of Pleasant View Road, east of Hwy. 351.

 

Mr. Patteson made a motion to approve this request subject to the right-of-way being shown as not less than 30' from centerline on Pleasant View Road and subject to a street improvement agreement being signed by the owners. The motion was seconded by Mr. Coleman. Voting was 6 in favor, 0 opposed.  REQUEST APPROVED WITH STIPULATIONS.

 

#23  PUD90-2  Coy Mac Boyd and Dear Tyrer requested pre-preliminary approval of a Residential Planned Unit Development to be called Ridge Pointe. The development contains approximately 320 acres. The property is located on the north side of Wood Springs Road, west of Friendly Hope Road.

 

A motion to table this request until 7-24-90 was made by Mr. Vance due to lack of information being presented for a timely review. Mr. Aycock seconded the motion. Voting was 5 in favor, 0 opposed, 1 abstained.  REQUEST TABLED.
