AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED DECEMBER 17, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas Western district on November 9, 1976; and
WHEREAS, said petition for the annexation of said lands was signed by all of the real estate owners owning the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing and hearing was duly had upon said petition in the County Court on December 17, 1976, at which hearing it was duly found and declared by the court that said petition for annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days (30) have expired since the order of annexation dated December 17, 1976, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated December 17, 1976, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereafter be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants within the new annexation shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Bradley).
West Half of the North 670 feet of the Northeast Quarter of the Northwest Quarter of Section 15: and the South 360 feet of the East Half of the Southeast Quarter of the Southeast Quarter of Section 9; and the South 360 feet of the West 600 feet of the Southwest Quarter of the Southwest Quarter of Section 10; and the South 1 foot of the East 720 feet of the Southwest Quarter of the Southwest Quarter of Section 10; all in Township 14 North, Range 4 East, Jonesboro District of Craighead County, Arkansas.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are hereby assigned and attached to Ward 3.
Section 4: The lands and territory herein annexed to the City of Jonesboro have been zoned R-2.
Section 5: It is hereby fund and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
