Minutes of the November 8, 1994, meeting were approved as submitted.

 

#1 Cecil and Kathy Welch requested approval of placement of a mobile home in the 200 block of Magnolia Road.

 

Petition was submitted with no plat. Applicants were not present at the meeting.

 

Mr. Damron made a motion to table the request seconded by Mr. McCracken. Four voted aye, 0 no, one absent for vote. REQUEST TABLED (Action on this request taken later in the meeting)

 

#2 Wayburn Heavener requested approval of placement of a mobile home in the 1400 block of Magnolia Road.

 

Mr. Damron made a motion to table this request based on the same reasons as above. Four voted aye, 0 no, one absent for vote. REQUEST TABLED. (Action on this request taken later in meeting)

 

#3 RZ94-38 Bob W. Harrison requested approval of rezoning from R-1 to R-2 for the north 10’ of Lot 2, Block D of Southside Estates Second Addition. The property is located on the west side of Parker Annex Road, north of Greenmeadow Lane.

 

Apartments are proposed for Lot 1 and the 10’ additional space is needed to meet requirements for parking and drives. Lot 1 is zoned R-2.

 

Mr. Damron made a motion to approve the request, seconded by Mr. McCracken. Five voted aye, 0 no, REQUEST APPROVED.

 

#3A Bob W. Harrison requested approval of a replat for the same item.

 

Mr. McCracken made a motion to approve the replat, seconded by Ms. Shaw. Five voted aye, 0 no, REQUEST APPROVED.

 

#4 RZ94-39 Mary W. Mitchell requested approval of rezoning from R-1 to R-2 for Lot 18, Block 10 of the Ridgecrest Addition, also known as 500 Ridgecrest Drive.

 

This request is made in order to operate a daycare out of the home. Several neighbors spoke in opposition to the request.

 

Ms. Shaw made a motion to approve the request contingent upon a voluntary deed restriction to limit uses only as a daycare or single family home. Motion died for lack of a second.

 

Mr. McCracken made a motion to deny the request based on all surrounding property being zoned R-1. Mr. Damron seconded the motion. Four vote aye, one no, REQUEST DENIED.

 

The Chairman states the Welchs’ from Item #1 are in the Council Chambers and asked for a motion to re-open and bring this item back to the floor. Ms. Shaw made a motion to reconsider this item again, seconded by Mr. McCracken. Five voted aye, 0 no. MOTION CARRIED.

 

Mr. McCracken made a motion to approve the request subject to the staff verifying the adequacy of the petition, staff review of the plat and confirmation that it is ok, and the building inspector inspecting the mobile home to see that it complies with the ordinance. Ms. Shaw seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

Chairman states Mr. Heavener on Item #2 is present and asked for a motion to re-open that item for discussion. Mr. McCracken made a motion to reconsider Item #2. Ms. Shaw seconded, 5 voted aye, 0 no, MOTION CARRIED.

 

Mr. McCracken made a motion to approve the request subject to staff review of the petition to verify signatures, staff review of the plat to ensure that it is adequate and building inspector’s review of the mobile home for ordinance compliance. Mr. Pitts seconded the motion, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#5 RZ94-40 Jerry and Kathy Goodman requested approval of rezoning from R-1 to C-3 for 1.98 acres located on the north side of Highland Drive, east of Commerce Drive.

 

Mr. Pitts made a motion to approve the request, seconded by Ms. Shaw. Five voted aye, 0 no, REQUEST APPROVED.

 

#6 RZ94-41 Alec Farmer requested approval of a rezoning from R-1 to C-3 for 9.90 acres located on the north and south sides of W. Washington Avenue, west of Jeramy Drive.

 

Mr. Pitts made a motion to approve the request subject to 60’ right of way from centerline of Washington being shown on plat. Mr. McCracken seconded the motion, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#7 RZ94-42 Farmer Enterprises requested approval of rezoning from R-1 to C-3, and I-1 to C-3 for 22.91 acres located on the north and south sides of W. Washington Avenue, east of Jeramy Drive.

 

Ms. Shaw made a motion to approve the request subject to a 60’ right of way dedication from centerline of W. Washington Avenue. Mr. Pitts seconded with 5 voting aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#8 Bob D. Harrison requested approval of rezoning from C-3 to C-2 for 1.498 acres located on the east side of Market Place Drive, south of Nettleton Avenue.

 

The Board of Zoning Adjustment, in their meeting December 12, 1994, approved a variance for building apartments in C-2 if the zoning is approved by this body.

 

One property owner from the area expressed some opposition to this request on behalf of his tenants on the west side of the street. This project would be located adjacent to a 15 unit apartment complex already in existence.

 

Mr. Beadles made a motion to approve the request seconded by Ms. Shaw. Five voted aye, 0 no, REQUEST APPROVED.

 

#9 MP94-51 Bob D. Harrison requested approval of a minor plat containing 1.498 acres located on the east side of Market Place Drive, south of Nettleton Avenue.

 

Mr. McCracken made a motion to approve the request subject to the plat showing 30’ from centerline of Market Place. Ms. Shaw seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#10 SP94-25 Bob D. Harrison requests approval of an apartment complex containing 22 units on 1.498 acres located on the east side of Market Place Drive, south of Nettleton Avenue.

 

Mr. McCracken made a motion to approve the request subject to the site plan being revised to show 49 parking spaces. Mr. Damron seconded the motion, 3 voted aye, 2 no, REQUEST APPROVED WITH STIPULATION.

 

#11 RZ94-44 Robert M. Chastain requests approval of rezoning from I-1 to R-2 for 42.04 acres located on the north side of Johnson Avenue, west of Darrick Lane.

 

Mr. Beadles made a motion to approve the rezoning, seconded by Mr. McCracken. Four voted aye., one no, chair voted aye, REQUEST APPROVED.

 

#12 PP94-23 Robert Chastain requested preliminary approval of Windsor Landing Subdivision containing 62 lots on 19.02 acres. The property is located on the north side of Johnson Avenue, west of Darrick Lane.

 

Mr. McCracken made a motion for approval subject to:

 

1.                     Right of way on Johnson being shown as 60’ centerline.

2.                     Items contained in staff report.

3.                     Conceptual drawing for whole subdivision presented are deficient in regard to access, acknowledgment for record, and if there are additional phases of this, there will have to be an additional means of access to subdivision before additional phases can be approved.

4.                     Granting utility easements as noted by CW&L.

 

Ms. Shaw seconded, 5 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#13 PUD94-2 John Marcom requested final approval of plans for Quail Ridge 4th Addition, a residential planned unit development containing 41 lots with one dwelling unit per lot. The subdivision is a continuation of Quail Ridge Drive eastward, south of Vail Drive.

 

Area residents spoke in opposition of this subdivision as presented. Some questioned whether the intent of the PUD ordinance had been met with the proposal as submitted.

 

Mr. Pitts moved to deny the request stating that this request does not fulfill the intent of the PUD ordinance, that it is being done for density purposes only, with nothing making it more special than being done as an R-1 subdivision. Mr. Pitts stated that one of the purposes of the PUD is to encourage development which is more desirable than that which would occur through strict application of the zoning and subdivision ordinances. Ms. Shaw seconded with 4 voting aye, one no, REQUEST DENIED.

 

#14 FP94-21 Todd Jackson requested final approval of subdivision plans for Lexington Estates containing 34 lots on 8.94 acres. The property is located on the east side of Wood Street, south of Plantation Oaks.

 

Mr. McCracken made a motion to approve the request subject to the granting of a 20’ sanitary sewer easement between lots 27 and 28. Ms. Shaw seconded, 4 voted aye, one no, REQUEST APPROVED.

 

#15 PP94-22 Bob Gibson requested preliminary approval of Barrett Place Second Addition, a subdivision containing 6 lots on 6.20 acres. The property is located on the northeast corner of Harrisburg Road and Fox Meadow Lane.

 

Mr. McCracken made a motion to approve the request subject to staff comments. Ms. Shaw seconded, 5 voted aye, 0 no, REQUEST APPROVED.

 

#16 PP94-24 Paul Throgmartin requested preliminary approval of Throgmartin Subdivision Phase VI containing 3 lots on 2.61 acres. The property is located on the north side of Prospect Road, west of Gerald Drive.

 

Ms. Shaw made a motion to approve the request subject to staff comments. Mr. Beadles seconded, 5 voted aye, 0 no, REQUEST APPROVED.

 

#17 PUD94-3 James Darnell requested approval of revised planned unit development plans for a part of Country Meadow Addition. Six residential units are proposed to be constructed on the lot. The property is located on the north side of Auburn Place, east of Hester Street.

 

Ms. Shaw made a motion to table the request because there was no one present representing the item to address questions by the Planning Commission. Mr. Beadles seconded the motion, 5 voted aye, 0 no, REQUEST TABLED.
