ORDINANCE TO VACATE AND ABANDON AN ALLEY EXTENDING FROM JACKSON STREET TO WASHINGTON STREET

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, praying that the City Council vacate and abandon the alley described as:
An alley running north and south through Block "H" of the original survey of the Town of Jonesboro, Arkansas, said alley extending from Jackson Street on the south to Washington Street on the north and being bounded on the east by Lots 4 and 11 in said Block "H" and being bounded on the west by Lots 5, 6, 7, 8, 9 and 10 of said Block "H" and being approximately 10 feet in width as shown on County Surveyor's Record 1 at page 5 at Jonesboro. And;
WHEREAS, after due notice as required by law, the City Council has at a time and place mentioned the notice, heard all persons desiring to be heard on the question and has ascertained that the alley heretofore described has heretofore been dedicated to the public use as an alley; that it has not been used by the public for a period of five (5) years, that the owners of all of the property abutting upon the alley to be vacated, have filed their petition with the City Council of such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacated and abandons all its right, together with the rights of the public generally, in and to the alley described as follows:
An alley running north and south through Block "H" of the original survey of the Town of Jonesboro, Arkansas, said alley extending from Jackson Street on the south to Washington Street on the north and being bounded on the east by Lots 4 and 11 in said Block "H" and being bounded on the west by Lots 5, 6, 7, 8, 9 and 10 of said Block "H" and being approximately 10 feet in width, as shown on County Surveyor's Record 1 at page 5 at Jonesboro, Arkansas.
Section 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County, and recorded in the deed records of said county.
Section 3: This Ordinance shall take effect and be in force from and after its passage.
