AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1, AS SHOWN ON THE ANNEXATION PLAT); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter more fully described, was duly filed in the County Court of Craighead County, Arkansas on July 2nd, 1987; and,
WHEREAS, said petition for the annexation of the land was duly signed by a majority of the property owners who own a majority of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the Quorum Court of Craighead County, Arkansas, on July 30, 1987 at 10:00 o’clock a.m., at which hearing it was duly found and declared that the petition for annexation was right and proper and that the lands hereinafter more fully described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,
WHEREAS, thirty (30) days have expired since the order of annexation was filed on July 30, 1987 and no proceedings to prevent the annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, the annexation proceedings were in all things confirmed by the Quorum Court of Craighead County, Arkansas, by its order of August 31st, 1987.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council for the City of Jonesboro, Arkansas:
Section One: The territories and lands annexed to the City of Jonesboro, Arkansas by order of the Quorum Court of Craighead County, Arkansas filed July 30, 1987 be and are hereby accepted by the City of Jonesboro, Arkansas, and the territory hereinafter more fully described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section Two: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more fully described as follows:
Lot 14 and part of Lot 13 of Heritage Heights Subdivision, Second Phase
Section Three: The lands and territories annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro and assigned and attached to Ward 6 of the City of Jonesboro, Arkansas.
Section Four: The lands and territories hereby annexed to the City of Jonesboro are hereby zoned Residential (R-1, as shown on the annexation plat).
Section Four: It is hereby found and declared by the City Council for the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accept by the City of Jonesboro, Arkansas, so that the property and the citizens of the territory described above can be entitled to fire, police, zoning, water sewage and other protections and benefits and that these benefits and protections are urgently needed now in order to allow orderly growth and development of the lands and territories hereinabove described.
THEREFORE, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.
