AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED DECEMBER 26, 1979, ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed with the County Court of Craighead County, Arkansas, Western District, on June 28, 1979, and
WHEREAS, said petition for annexation of said lands was signed by all the real estate owners owning acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said petition was entered notice was duly published of said hearing, and hearing was duly had upon said petition in the County Court on July 30, 1979, at which hearing it was duly found and declared by the Court that said petition for annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days have expired since the Order of Annexation dated December 26, 1979, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;
NOW THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated December 26, 1979, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits to the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
A part of the Northwest Quarter of the Northwest Quarter of Section 33, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner of said Section 33; thence South along said section line 420 feet to the point of beginning proper; thence continuing South along said section line 240 feet; thence East 521 feet; thence North 240 feet; thence West 521 feet to the point of beginning proper; said property being subject to an easement along the West side thereof for right-of-way of Caraway Road.
Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned to Ward 6.
Section 4: The lands and territories herein annexed to the City of Jonesboro, have been zoned C-3.
Section 5: It is herby found and declared by the City Council of the City of Jonesboro, Arkansas, that the immediate plans for development of area hereby annexed to the City of Jonesboro, Arkansas require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
