Minutes from the City Council meeting on August 16, 1999

The Jonesboro City Council met Monday, August 16, 1999, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk, Donna K. Jackson, City Attorney Phillip Crego and 11 council members. Those members were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Kelton and Councilman McCall were unable to attend.

 

Councilman Perrin moved, seconded by Councilman Roddy for approval of the minutes from August 2, 1999, as delivered. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE AUTHORIZING A DEPOSIT AGREEMENT WITH ARKANSAS STATE UNIVERSITY FOR INCLUSION IN THE ARCHIVES AND SPECIAL COLLECTIONS OF THE DEAN B. ELLIS LIBRARY

 

Councilman Young moved, seconded by Councilman Tate to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Tate to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Tate offered the following ordinance for first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Knights of Columbus)

 

Councilman Tate moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Perrin to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Rega offered the following ordinance for first reading:

Councilman Rega moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Councilman Perrin moved, seconded by Councilman Crockett to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Councilman Tate offered the following ordinance for first reading:

Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Councilman Young offered the following ordinance for first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF BERMUDA SOD FOR THE PARKS DEPARTMENT

 

The following questions were asked by various council members: How much sod would be provided for the $12,632.00; was Emerald Ridge Turf Farm the only bidder; Would sprinkler systems be operational once the grass was installed. Mr. Larry Johnson, the Mayor’s Assistant responded, saying the $12,632.00 would fund double plugs for 15.8 acres including delivery and installation. Mr. Johnson further explained bids were taken by other companies but did not include installation. Mayor Brodell stated the sprinkler system was already installed and operational. Councilman Copeland moved, seconded by Councilman Moore to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Perrin to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Crockett for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Councilman Province offered the following ordinance:

Councilman Rega moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Perrin moved, seconded by Councilman Roddy to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Copeland moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Councilman Young moved, seconded by Councilman Copeland to move the next council meeting to Tuesday, September 7, 1999, due to the Labor Day Holiday. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Perrin moved, seconded by Councilman Moore for the adoption of a resolution to set a public hearing for September 7, 1999 at 6:15 p.m. regarding the abandonment of an undeveloped portion of Main Street, located in Belmont Addition for Fowler Foods. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned number 1999:34.

 

Councilman Perrin moved, seconded by Councilman Young for the adoption of a resolution to place 25 M.P.H. speed signs at Clark and School Streets. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned number 1999:35.

 

Mayor Brodell explained Agenda Item 7, signalization of Highway 49 and Johnson Ave was the responsibility of the Arkansas State Highway and Transportation Department, and pulled the item from the agenda.

 

Under new business, Mayor Brodell reported on the new Central Fire Station and a fifty year lease agreement with Arkansas State University. He explained the base bid was $2,218,000.00 minus $38,005.00 for changes in electrical fixtures, ceramic tile, and precast trim. He also reported a $50,000.00 reimbursement from City Water & Light due to a specific heating and cooling system which would conserve energy. The total deductions from the base bid was $88,000.00 for a balance of $2,130,000.00. Mayor Brodell then added $127,800.00 for architectural work which brought the balance to $2,257,800.00. He explained originally $1,750,000.00 had been budgeted, but $507,800.00 was needed to complete the project. However, the $507,800 did not include the construction of a four lane road, nor furniture. He requested Council to accept the bid of Tate Construction and appropriate the additional $507,800.00. Mayor Brodell explained the City would be requesting a $50,000.00 grant which would apply toward the air-conditioning system. He also explained it was imperative for Council to act on the bid tonight because Tate Construction had been delayed for two weeks while negotiations were taking place over the lease agreement with Arkansas State University. Councilman Tate moved, seconded by Councilman Roddy to accept the bid from Tate Construction for $2,257,800.00. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Perrin to appropriate $507,800.00 to come from the Capital Improvement Fund. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Moore recommended running an advertisement in the Jonesboro Sun, informing citizens that fines will be issued for leaving trash cans by the curb for an extended period of time. Also, Councilman Moore inquired about the status of the Ebbert property on 1210 S. Madison. City Attorney, Phillip Crego responded saying the foreclosure decree has been entered ordering the property sold, and a clerk was appointed to conduct the sale. Attorney Crego stated a date for the sale has not been set, and until the day of the sale Mr. Ebbert could possibly come up with the needed funds to stop the foreclosure.

 

Councilman Perrin moved, seconded by Copeland for the adoption of a resolution requesting City Water and Light to provide free utility service to 231 S. Main. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Tate, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned number 1999:36.
