AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY OTHER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-3); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on August 25, 1980; and
WHEREAS, said Petition the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was duly had and held in the County Court of Craighead County, Arkansas on September 8, 1980, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the Order of annexation dated September 9,, 1980 and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its Order of October 20, 1980.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas by its Order of September 9, 1980, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and a parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitance residing therein shall have and enjoy all the rights and privileges of the inhabitance within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas more particularly described as follows:
A part of the South ½ of the SW ¼ of the NE ¼ of Section 29, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Southwest Corner of aforesaid SW ¼ NE ¼; thence N 89°02’ E on the 40 acre line 50.0’; thence N 0° 11 ½’ E 50.0’ to the North R/w line of Race Street; thence N 89° 02’ E along said R/W line 149.0’; thence S 89° 03’ E along said R/W line 21.01’ to the point of beginning proper; thence N 0°11 ½’ E 342.15’; thence S 89° 05’ W 170.0’ to the East R/W line of Browns Lane; thence N 0° 11 ½’ E along said R/W line 60.0’; thence N 89° 05’ E 160.0’; thence N 0° 11 ½’ E 207.0’ to the North line of said S ½ SW ¼; thence N 89°05’ E along the 20 acre line 519.85’; thence S 0° 11 ½’ W 625.74’ to the North R/W line of Race Street; thence N 89°03’ W along said R/W line 509.30’ to the point of beginning proper, containing 7.50 acres.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Residential (R-3).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning, water and sewage and other protection and benefit that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
