AN ORDINANCE TO AMEND TITLE NINE, KNOWN AS “STREETS AND SIDEWALKS”, BY AMENDING SECTION 9.38 KNOWN AS “STREET SPECIFICATION”, AND FOR THE PURPOSE OF DEFINING THE DESIGN AND QUALITY CONTROL OF ASPHALT MIXTURE FOR USE IN NON-STATE PROJECTS.

WHEREAS, the City of Jonesboro considers it necessary to define the design and quality control of asphalt mixtures for use within the City for non-state projects; and
WHEREAS, there is a necessity for the City to modify its Street Improvement Program Standards Manual, as previously adopted with regard to Street Specifications.
THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas the following:
SECTION 1: All references to asphalt specifications referred to in this Ordinance shall be governed by the Standard Specification for Highway Construction of the Arkansas Highway Transportation Department (AHTD), 1996 edition.
SECTION 2: The City of Jonesboro does hereby amend the Street Specification regarding asphalt mix for use of non-state projects within the City as contained in Table 407-1 of AHTD 1996 edition.
SECTION 3: That the asphalt mix design shall be performed by two laboratories that are on the list of the Department of the Arkansas Highway and Transportation Department of approved asphalt mixed designed laboratories (QPL) or one QPL and approved by the Engineer of Materials of the AHTD and a copy of the mixed design and a copy of the approval form shall be provided to the City Engineer. A report from a QPL on all asphalt production for non-state projects shall be submitted to the City Engineer for the City of Jonesboro, Arkansas, for every 750 tons to insure quality control and the City Engineer shall determine if the reported sample submitted is in compliance with the requirements set forth in Table 407-1.
SECTION 4: Any asphalt plant inspection required shall conform to Section 409 and be preformed by a QPL or the Arkansas State Highway and Transportation Department.
SECTION 5: Scales used by and asphalt plant shall be certified in accordance with Arkansas law.
SECTION 6: All ordinances and or parts of ordinances in conflict herewith are hereby specifically amended and no other changes are hereby made.
SECTION 7: It is found and declared by the City Council of the City of Jonesboro that this ordinance is necessary to establish street specifications and that these procedures are necessary for the efficient and orderly operations of city government and that, thereof, an emergency exists and this ordinance being necessary for the preservation of the public peace, health, and safety, it shall take effect from and after its passage and approval.
