AN ORDINANCE TO AMEND SECTION 2-103 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, CREATING MEMBERSHIP FOR THE ADVERTISING AND PROMOTION COMMISSION

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That Section 2-103 of the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended to read as follows:

                     

A. That the City of Jonesboro Advertising and Promotion Commission is hereby created. The Commission shall be composed of seven members who shall be qualified electors of the City of Jonesboro. Four members shall be hotel, motel or restaurant owners or managers, who shall be appointed by the Mayor with the approval of the governing body of the City, for staggered terms of four years; the remaining three members of the Commission shall be the Mayor and two members of the governing body of the City selected by the governing body. The appointment of the four hotel, motel or restaurant members appointed by the Mayor shall, at the first meeting of the Commission, draw lots for terms so that one of such members will serve for a term of one year, one shall serve for a term of two years, one shall serve for a term of three years and one shall serve for a term of four years, and all successors to such members shall be appointed for a term of four years. The Mayor and the two members of the governing body shall be appointed for a term consistent with their term of office. In the event of a vacancy occurring on said Commission, it shall be filled by appointment by the Mayor, subject to the approval of the Jonesboro City Council. Each Commissioner shall file the oath required by law in the State of Arkansas public officials. Each Commissioner shall furnish to the City of Jonesboro a $5,000.00 Surety Bond that will serve to insure the City against misappropriation or mishandling of funds. The surety on said bond shall be a reputable surety corporation. Premiums on said bond shall be paid from the City of Jonesboro Advertising and Promotion Fund.

B. Any Commissioners appointed under the provisions of this article may be removed for cause upon a two-thirds vote of the Jonesboro City Council.

 

Section 2: All ordinances and/or parts of ordinances in conflict herewith are hereby specifically repealed.

 

Section 3: It is found and declared by the City Council that the composition of the Advertising and Promotion  Commission has not been amended to conform with current state law and that conformance with the state law is necessary to carry out the activities which are now being undertaken by the Advertising and Promotion Commission and that, therefore, this ordinance, being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
