AN ORDINANCE ABANDONING AND VACATING A PORTION OF STREET RIGHT OF WAY AND CERTAIN UTILITY EASEMENTS ON THE EAST END OF MARCHBANKS CIRCLE IN THE MARCHBANKS ESTATES SUBDIVISION AS REQUESTED BY RICK WYATT

WHEREAS, the City Council at its regular meeting on September 5, 2000 pursuant to Ark. Stats. Section 14-301-302 through 14-301-304 heard the request of Rick Wyatt to abandon a portion of Street Right of Way and certain Utility Easements on the east end of Marchbanks Circle; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, all utility companies have consented to said abandonment; and
WHEREAS, the abandonment of said portion of the right of way would not adversely affect any utility companies and would be in the best interest of all parties concerned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas hereby vacates and abandons all of its right together with the right of the public generally, in and to a portion of street right of way and certain utility easements on the east end of Marchbanks Circle described as follow:

Part of Marchbanks Estates to the City of Jonesboro, Arkansas, being more particularly described as follows:
Begin at the Northeast Corner of Lot 14 of Block "A" of Marchbanks Estates to the City of Jonesboro, Arkansas; thence South 0º00'24" West 162.72 feet to the point of beginning proper; thence Continue South 0º00'24" West 120.01 feet; thence Northwesterly along a 191.00º curve to the left with a radius of 30.00 feet a distance of 47.54 feet; thence South 89º12'45" West 67.81 feet; thence Northerly along a 114.60º curve to the left with a radius of 50.00 feet a distance of 64.35 feet; thence North 89º12'45" East 69.47 Feet; thence Northeasterly along a 191.00º curve to the left with a radius of 30.00 feet a distance of 46.71 feet to the point of beginning proper, containing 0.135 acres, (5896.16 square feet).
NORTH EASEMENT ABANDONMENT:
Part of Lots 13 and 14 of Block "A" Of Marchbanks Estates to the City of Jonesboro, Arkansas, being more particularly described as follows:
Begin at the Southwest Corner of Lot 13 of Block "A" of Marchbanks Estates to the City of Jonesboro, Arkansas; thence North 89º12'45" East 29.54 feet to the point of beginning proper; thence Northeasterly along a 229.20º curve to The left with a radius of 25.00 feet a distance of 16.09 feet; thence North 89º12'45" East 145.46 Feet; thence Northeasterly along a 229.20º curve to the left with a radius of 25.00 feet a distance of 38.92 feet; thence South 0º00'24" West 16.58 feet; thence Southwesterly along a 191.00º curve to the right with a radius of 30.00 feet a distance of 29.14 feet; thence South 89º12'45" West 160.46 feet to the point of beginning proper, containing 0.021acres, (900.01 square feet).
SOUTH EASEMENT ABANDONMENT:
Part of Lots 5 and 6 of Block "B" of Marchbanks Estates to the City of Jonesboro,
Arkansas, being more particularly described as follows:
Begin at the Northwest Corner of Lot 5 of Block "B" of Marchbanks Estates to the City of Jonesboro, Arkansas; thence North 89º12'45" East 61.82 feet to the point of beginning proper; thence continue North 89º12'45" East 158.80 feet; thence Southeasterly along a 191.00º curve to the right with a radius of 30.00 feet a distance of 29.97 feet; thence South 0º00'24" West 16.55 feet; thence Northwesterly along a 229.20º curve to the left with a radius of 25.00 feet a distance of 39.59 feet; thence South 89º12'45" West 143.80 feet; thence Northwesterly along a 229.20º curve to the left with a radius of 25.00 feet a distance of 16.09 feet; to the point of beginning proper, containing 0.021 acres, (904.51 square feet).
SECTION 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and in the Deed Records of Craighead County, Arkansas.
SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described portion of right of way and easements are in the public interest and will promote the public peace and welfare. And further the City Council finds that an emergency exists and this Ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same shall take effect from and after its passage and approval.
