A RESOLUTION AUTHORIZING THE MAYOR TO CONVEY CERTAIN REAL PROPERTY BELONGING TO THE CITY OF JONESBORO; AND PRESCRIBING OTHER MATTERS RELATING THERETO

BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: The City Council of the City of Jonesboro, Arkansas has determined that it would be in the best interest and welfare of the public to convey the following described piece of real property located in the Western District of Craighead County, Arkansas to Don Gilbert Industries, Inc., to-wit:
A part of the Northeast Quarter of the Southeast Quarter of Section 26, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Southeast Corner of said Northeast Quarter of the Southeast Quarter aforesaid; thence South 88 degrees 42 minutes West 797.42 feet to an iron pipe set, the point of beginning proper; thence continue South 88 degrees 42 minutes West 450.0 feet to an iron pipe set on the South right-of-way line of Krueger Drive; thence North 88 degrees 42 minutes East along the South line of Krueger Drive 450.0 feet to an iron pipe set; thence South 417.4 feet to the point of beginning proper, containing 4.311 acres, subject to 20 foot utility easement along South line.
SECTION 2: That for and in consideration of the sum of Twenty-Five Thousand Eight-Hundred and Sixty-Six Dollars ($25,866.00) paid by Don Gilbert Industries, Inc., the City of Jonesboro, Arkansas does hereby grant, bargain, sell and convey the above described real property unto the said Don Gilbert Industries, Inc. To have and to hold said premises, together with all appurtenances thereunto belonging. And the City of Jonesboro, Arkansas hereby covenants with said Don Gilbert Industries, Inc. that it will forever warrant and defend the title to said land against all lawful claims whatsoever.
SECTION 3: The Mayor and City Clerk are hereby authorized and directed to execute and attest respectfully, a warranty deed between the City of Jonesboro, Arkansas, a Municipal Corporation, and Don Gilbert Industries, Inc., providing for the conveyance of the above described real property under the terms and conditions being contained in this resolution.
