COMMISSIONERS PRESENT: HALSEY, MOORE, HARPOLE, GOTT, KRENNERICH, ROBERTS AND BEADLES

 

COMMISSIONERS ABSENT: DAY AND SAWYER

 

STAFF PRESENT: TOMLINSON, ROOK AND MARTIN

 

Chairman Beadles called the meeting to order at 7:00 pm.

 

On a motion by Mr. Gott and seconded by Harpole the minutes of the December 13, 2005 meeting were approved by unanimous vote.

 

1.  RZ-05-39                     Harrell Mays request recommendation to the City Council for approval of rezoning from R-1 Single-Family Medium Density to R-1A Single Family High Density, 9.54 acres located north of Greensboro Road and East of Scott Street.

 

Dr. Beadles ask for the proponent of this item, Carlos Wood came forward as engineer and representing the owner. This property lies within mostly rental property and this is reason for requesting this zoning. Dr. Beadles ask for opponent to this item there was none, ask for comments from City Planner or City Engineer, there were no comments. Dr. Beadles ask for commissioner’s comments or motion. Mr. Harpole made motion that they recommend approval to the City Council, seconded by Mr. Gott. The vote was unanimous for approval.

 

2.  PP-05-15                     Harrell Mays request preliminary approval of a 33-lot residential subdivision on 9.54 acres located north of Greensboro Road and East of Scott Street. (NOTE: THIS ITEM WITHDRAWN PENDING REZONING APPROVAL SEE ITEM #1.)

 

3.  RZ-05-36                     Robert Rees request recommendation to the City Council for approval of rezoning from R-1, R-3 and C-3 to R-6, property located south of Highland Park Circle, west of Pausch Drive, North of Highland Drive, and east of Dara Drive.  (NOTE: THIS WAS WITHDRAWN DUE TO NOT POSTING SIGNS)

 

4.  RZ-05-38                     Jim Able request recommendation to the City Council for approval of rezoning from C-3 General Commercial to R-1 Single-Family Medium Density, 36.16 acres located south of Green Meadow Lane, east of Hunters Ridge Drive, west of Higginbottom Creek, and north of Savannah Drive.

 

Dr. Beadles ask for proponent for this item. Terry Bare came forward to represent the owner, this property is part of the former Gladiola Farms. Mr. Able has purchased and would like to rezone to residential. Dr. Beadles ask for opponents to this item, there were none. Ask for comments from City Planner, stated there may be some problems with ingress/egress but these will be addressed with subdivision plat. City Engineer had no comments. Mr. Krennerich made motion to recommend to the City Council that this item be approved, seconded by Ms. Moore. The vote was unanimous to approve.

 

5.  RZ-05-35                     Jerry McCormick request recommendation to the City Council approval of rezoning from AG-1 to R-1 Single-Family Medium Density, 27.22 acres located north off Flemon Road, approximately 1,660 ft. east of Woodsprings Road and approximately 2,000 ft. west of Friendly Hope Road.

 

Dr. Beadles ask for proponent for this item. Skip Mooney, attorney, came forward representing owner. Mr. Mooney stated that best use of this property is residential that the tract is too small to farm and is not being used at this time. The owner to be able to sell this property is asking that it be rezoned to R-1, this property lies next to Beaver Creek Subdivision, property that this commission approved for rezoning. A local developer is interested in buying this property subject to rezoning. This will be submitted to you as preliminary plat at a later time.

 

Dr. Beadles ask for opponent to this item. David Tyler, attorney, came forward to represent some of the property owners in the area. Mr. Tyler had a handout for each commissioner with information that he stated that they probably already knew but he wanted them to have the information handy. Mr. Tyler stated that the property owners were not against development, they are against this type of zoning. The R-1 zoning will allow up to 5 units per acre to be allowed in this area, and when you check the Comprehensive Plan for the City of Jonesboro, it shows this area to be Low Density or Village Residential which would only allow for 3 units per acre and Village Residential could not be used because it calls for minimum of 75 acres. They are against the R-1 zoning and would prefer a low density zoning. Their concerns are for the number of units that would be put in this area along with the Beaver Creek Subdivision that is next to this property with a narrow outlet onto Flemon Road with the increased traffic that these two subdivisions will bring to the area. With the location in the extreme southwest part of the city, police and fire protection will have a great distance to travel to this area. This is why the property owners in this area oppose this type of zoning.

 

Dr. Jim Sanders spoke as opponent to this item owns property next to the property in question. Stated that police protection in this area is one officer per shift, per day, nearest fire station is at Wood St. and Southwest Dr. Drainage in the area is going to be a problem with an additional subdivision. Traffic problems will increase with the number of cars and also school buses that will have to use Flemon Road. There will have to be street improvements to accommodate the additional traffic in the area. Also to have enough land for the houses proposed for this subdivision they will have to cut the trees at the north side of this property that could be used as a buffer for this property.

 

Dr. Beadles ask that all those opposed to this item stand, approximately 15 people stood.

 

Mr. Mooney stated that he spoke only to the rezoning item and that item #6 which is the preliminary plat for this property be withdrawn, and that the commission on consider the rezoning. Dr. Beadles stated that is all the commissioners will address at this meeting. Mr. Mooney stated that the proper use of this property is residential. So he asks that you rezone this property to R-1.

 

There were no comments from City Planner or City Engineer. Dr. Beadles ask for comments or motion. Mr. Harpole asks to clarify the difference in R-0 and R-1 zoning. Mr. Tomlinson state the lot size is different with R-0 being 15,000 sq. ft. to R-1 being 8,000 sq. ft. so therefore there would be a difference in density.

 

Mr. Krennerich made motion to recommend to the City Council that they deny the request. Seconded by Ms. Moore. The vote was 3 yes by Moore, Gott and Krennerich and no by Halsey, Harpole and Roberts. With no majority vote of 5 the commissioners ask that they send to City Council with no recommendation. Mr. Halsey made motion that this be done, seconded by Roberts. The vote was 5 to 1 with Krennerich voting no to send to the City Council with no recommendation.

 

6.  PP-05-16                     Rick Turman request preliminary plat approval for PRAIRIE MEADOW an 87-lot residential subdivision on 27.23 acres located north off Flemon Road, east of Woodsprings Road and west of Friendly Hope Road. ( NOTE: THIS ITEM WITHDRAWN, SEE ITEM #5.)

 

7. RZ-05-37                     Keith Bryson request recommendation to the City Council approval of rezoning of 2.19 acres located on south side of Johnson Avenue between Airport Road and Old Paragould Road, from R-1 Single-Family Medium Density to C-3 General Commercial.

 

Troy Sheets with Associated Engineering as proponent for this item representing Mr. Bryson. Stated the property is bordered on south by I-1, north Johnson Ave. and Mr. Joel Bednar owner of property to the west has no objection to C-3 zoning. There were no opponents to this item. No comment from planning or engineering.

 

Mr. Harpole made motion to recommend approval seconded by Mr. Halsey. The vote to approve was unanimous.

 

8.  PP-05-17                     Rick Turman request preliminary plat approval for STONERIDGE ESTATES PHASE II, 23.50 acres located west of Griffin Estates, south of Flatrock Trail, approximately 200 ft. south of the intersection of Keller’s Chapel Road and Darr Hill.

 

Carlos Wood as engineer and representative for owner came forward as proponent for this item. This is phase II and final phase for this subdivision with the same lots as in phase I.

 

Mr. Krennerich made motion for approval with the 4 stipulations listed in comments, entire street width of Stoneridge be constructed in phase II as shown on the plans and drainage easements as shown on record plat for all drainage systems. Record plat will match layout and retention pond in details and drainage report for proposed development. Seconded by Ms. Moore. The vote was unanimous to approve.

 

9.  PP-05-18                      SBC INVESTMENTS, LLC request preliminary plat approval for ROLLING RIDGE ADDITION a residential subdivision on 20.41 acres located East of Forest Hill Road, north of Craighead Forest Road, west of Harrisburg Road, south of Sugar Creek Drive and Russell Hill Drive. (A portion of the former Craighills Golf Course.)

 

Terry Bare and Robert Hendrix as proponents for this item, prepared the subdivision plan and will answer any questions. There were no opponents.

 

Mr. Krennerich made motion to approve with the 8 stipulations listed and that the Subdivision complies with all city and fire ordinances. Seconded by Mr. Gott. The vote was unanimous to approve.

 

10. PP-05-13                     Frank Macon, Sr. request Preliminary Plat approval for WILDERNESS RUN a 12-lot residential subdivision on 14.12 acres, located north of Lawson Road.

 

Carlos Wood as proponent representing the owner, stated this is final phase of this subdivision with one acre lots. There were no opponents. Mr. Krennerich made motion to approve with the stipulations already stated and add that there will be no work to begin on this phase until work is completed on Phase I. Seconded by Mr. Gott. The vote was unanimous to approve.

 

11. PP-5-14                     Danny Wallis and Randy Simpkins request preliminary plat approval of RIDGE RUN PH-VI a 39-lot residential subdivision on 13.61 acres located west of Old Paragould Road, north of Prospect Road, south of Oak Hill Lane and east of Sandra lane.

 

Carlos Wood represented owner as proponent for this item. Final development for this subdivision, with the same lot sizes. Mr. Gott made motion to approve, seconded by Mr. Harpole with stipulation 1.detention pond details and drainage report, 2. show pipe between lots 28 & 29. The vote was unanimous to approve.

 

12. PP-05-12                     Bob Troutt request preliminary plat approval for WILDWOOD ADDTION a 54-lot residential subdivision on 14.26 acres located on the east side of Old Paragould Road.

 

Terry Bare and Robert Hendrix came forward as proponent and prepared this preliminary plat, and will answer any questions. There were no opponents. There was a discussion about ingress/egress for this project. Stated there would be outlet on phase II. There is an agreement with the adjoining Prospect Farms Subdivision to have street connecting the two for in and out for both subdivisions. Also discussed drainage and how sewer would be brought into the subdivision.

 

Mr. Roberts made motion to approve with stipulations stated above, seconded by Mr. Halsey. The vote was unanimous to approve.

 

13. FP-05-13                     Robin Nix request Final Plat approval for JACOB’S FIELD a 27-lot residential subdivision on 9.24 acres located south of Johnson Avenue and west of Disciple Drive. (Preliminary Plat approval was given under the name JOHN HARDY MEADOW PHASE II.)

 

Proponent for this item was Carlos Wood. There were no opponents. Claude Martin, engineer stated all comments on this subdivision have been corrected. Mr. Krennerich made motion to approve seconded by Mr. Harpole. The vote was unanimous to approve.

 

Two items not on the agenda were viewed at the Planners request.  A Minor Plat submitted by Mark Webb was discussed and a motion by Mr. Krennerich and seconded by Mr. Harpole to approve with a unanimous vote.

 

The commissions discussed the discrepancy in the zoning ordinance for C-5 as stated on page 32 and the uses as listed on page 34 and dimension requirements table on page 38 do not agree. The commissioners voted unanimously to amend the ordinance to show all these pages to match.

 

Dr. Beadles adjourned the meeting at approximately 8:15 pm.
