AN ORDINANCE TO AMEND ORDINANCE NO. 1547 ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED AUGUST 13, 1976, SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY C-3; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, an amended petition for the annexation of certain lands to the City of Jonesboro, Arkansas, herein after described, was duly filed in the County Court of Craighead County, Arkansas, on January 24, 1977; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing on said petition was entered, notice was duly published of said hearing, and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on March 4, 1977, at which hearing it was duly found and declared that said amended petition for annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexed dated March 4, 1977, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were all things confirmed by the County Court of Craighead County, Arkansas, by its order of April 4, 1977;
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas, that Ordinance No. 1547 be amended as follows:
Section 1: The territories and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its amended order of March 4, 1977, be and are hereby accepted by the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the privileges and rights of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Fisher Annexation)
Begin survey at the SW corner of the SW ½ of Section 23, Township 14 North, Range 4 East; thence North along the Section line 490 feet to a point; thence North 89° 16’ East 30 feet to the point of beginning proper; thence North 332.15 feet to a point; thence North 89°26’ East 1283.55 feet to a point; thence South 0°05’ East 758.8 feet to a point on the North right-of-way of Arkansas State Highway No.18; thence South 89°16’ West along said North right-of-way 1101.7 feet to a point; thence North 29°56’ West along the East right-of-way of Kathleen Street 148.8 feet to a point; thence North 89°16’ East 91.85feet to a point; thence North 300.0 feet to a point; thence 89°16’ West 200 feet to the point of beginning proper, less and except the South 400 feet of the above described property.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6 of the City of Jonesboro, Arkansas.
Section 4: That said lands here and above described are hereby zoned Commercial (C-3).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme emergency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and citizens as property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territories; that said ordinance needs to be amended to show the correct property description and location of property, and therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effects and be in full force from and after its passage and approval.
PASSED and ADOPTED this 4th day of April, 1977.
