AN ORDINANCE TO AMEND SECTION VII OF ORDINANCE NO.1000 OF THE CITY OF JONESBORO, ARKANSAS, SAME BEING AN ORDINANCE CREATING THE OFFICE OF CITY INSPECTOR AND COMBINING THE OFFICES OF BUILDING, PLUMBING, ELECTRICAL AND GAS INSPECTORS, PRESCRIBING THE QUALIFICATIONS THEREFORE, AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Section VII of Ordinance No.1000 of the City of Jonesboro, Arkansas be and is hereby amended to read as follows:

 

AUTHORITY: No water, electricity or gas shall be turned on for service in premises in which the construction, work or installation does not comply with the ordinances of the City of Jonesboro, Arkansas; and such service shall not be turned on by the gas, water or electric utility except upon receipt of a final permit or certificate of completion and inspection by the City Inspector; provided, that water, electricity or gas may be turned on for construction work only in unfinished buildings.

 

Any applicant for a final permit or certificate of completion and inspection shall present proof to the City Inspector that the property and newly completed building has been listed for assessment with the county tax assessor of Craighead County, and such applicant shall present a copy of such certificate of listing for assessment duly signed and certified to by the county tax assessor with his application for final permit or certificate of completion and inspection.

 

From and after the effective date of this ordinance, it shall be the duty of the City Inspector of the City of Jonesboro or any other person now or hereafter authorized to issue final permit or certificate of completion and final inspection to require the applicant to submit proof that said property and the newly completed building has been listed for assessment with the county tax assessor as hereinabove provided, and the City Inspector shall issue no such final permit until a copy of such listing is on file in his office. Said City Inspector shall maintain a file or record preserving said listings.

 

It being the purpose of this ordinance to require that all new construction in the City of Jonesboro be listed for assessment with the county tax assessor before any final permit or certificate of completion and inspection by issued and before any water, electric or gas shall be turned on for service in the premises.

 

Section 2: PENALTY: Any person, firm or corporation, or any official charged with the responsibility of enforcing this ordinance, or any person or official responsible for turning on any water, electric or gas service in the City of Jonesboro, Arkansas, violating any provision of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any sum not to exceed $100.00.

 

Section 3: EMERGENCY CLAUSE: It is hereby found and determined by the City Council that much new construction and building within the City of Jonesboro, Arkansas is not being assessed upon the tax records of Craighead County and the City of Jonesboro, and that thereby the City of Jonesboro is losing much tax revenue, and that some means of requiring that said new construction and buildings be assessed is absolutely necessary; therefore, an emergency is hereby declared to exist and this ordinance being necessary for the immediate preservation and protection of the public peace, health and safety, shall be in full force and effect from and after its passage and adoption.
