A RESOLUTION TO FORM A COMMITTEE AND HIRE A CONSULTANT TO STUDY IMPACT FEES IN THE CITY OF JONESBORO

WHEREAS, the City Council is reviewing proposed changes to its zoning regulations, and has been considering the issue of impact fees; and

 

WHEREAS, it is crucial to determine the impact of development in the city before considering changes to the city code or the assessing of said fees; and

 

WHEREAS, the City Council believes such a study may take several months, and an expert is required to conduct an accurate study on impact fees and make recommendations for what, if any, fees would be appropriate; and

 

WHEREAS, it is the desire of the City Council to begin the search to find an expert for the study. 

 

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF JONESBORO, ARKANSAS THAT:

 

1.                     A consultant qualified in conducting an impact fee study shall be hired by the city and the City Council hereby authorizes the Mayor to immediately advertise a request for qualifications for a consultant to study this issue in the City of Jonesboro.  The RFQ responses will then be submitted to the Impact Fee Committee for review and recommendations on hiring in January 2024.

2.                     The City Council hereby creates a citizen committee to study impact fees in the City of Jonesboro.  Any citizen interested in serving on said committee should submit an email with name, address, and a description of any expertise in construction, development, zoning, or other areas relevant to this issue to Chris Gibson, Chair of the Rules and Nominating Committee and the Mayor’s office by December 31, 2023.  The intention of the Council is to have this Committee appointed in January 2024 so that work can begin on this issue immediately.  

3.                     The City Council grants the Committee the authority to review the requests for qualifications and select the consultant to perform the study.

4.                     The Council will review proposed changes to the code of ordinances as recommended by the Committee with input from relevant staff, consultants, the public, and any other interested entities or individuals.  Any changes to the Code of Ordinances shall be presented to the City Council for consideration and adoption.

5.                     In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this resolution.

6.   All resolutions or other matters in conflict with this resolution are hereby repealed to the extent of any inconsistency.
